Hi Guys,

Need desperate assistance on this topic. Can somebody advice what is missing on my plan of action? My account was suspended for two inauthentic complains.

Complaint One’s POA:

Inauthenticity Root cause

  1. I had received a complaint from Brand representative that I mapped their listing without reseller rights and they had mentioned that my product does not have brand logo.

  2. The reason behind the complaint is that , there was no listing restriction on this ASIN. As a result, I have mapped this listing without getting brand authorization and not sourced this product from authorized supplier or distributer.

  3. Being a new seller and not having a trained team, I was not aware of the policies of Amazon and do’s and don’ts of mapping listing and products sourcing. I mapped the brand listing without brand authorization and sourced product without from unauthorized supplier.

  4. I believe, above vital mistakes are the root causes of customer inauthenticity complaint.

Corrective measures to resolved the inauthenticity issue.

  1. After reading Amazon Anti-Counterfeiting Policy, we came to know that we have violated the policy therefore, we had deleted entire listing immediately. A removal order has been placed for all remaining inventory and we have destroyed all of them .

  2. To correct inauthenticity issue, we have decided to discontinue selling of this ASIN permanently .

  3. To permanently resolved inauthenticity issue , we have gone through Brand Name Policy and we have actioned the following:

3 -a Since our brand is not eligible for Brand Registry, we have obtained a GTIN exemption in electronic category as Brand name “ MyBrandName ”.
3 -b We used brand name “MyBrandName” when creating the listing.
3 -c We have printed “MyBrandName” logo in our product. It can be verified from our inventory in Amazon FC.
3 -d We are not using trademark of any other brands in our entire listing catalog and inventories.

  • How I will prevent this issue in future
  1. We have decided to discontinue selling of this ASIN permanently and we will not map any listing that requires brand authorization.

  2. We will only create our own listing using “MyBrandName” brand and will use “MyBrandName” logo in all of our products. To support this statement, we have already started practicing this approach and It can be verified from our inventory in Amazon FC.

  3. In case, if we need to sell any branded item , we will make sure that the product should be authentically procured from the brand or authorized suppliers. How I will verify supplier , I will obtain a list of authorized suppliers directly from the brand and purchase from those suppliers or distributors.

Inauthenticity Root cause

  1. One customer had initiated return request and raised a complaint of inauthenticity.

  2. The reason behind the complaint is that , we have bought this product from China. The supplier was not Brand authorized distributor.

  3. We have mapped this listing without sourcing product from authorized supplier or distributor.

  4. I believe, above vital mistakes are the root causes of customer inauthenticity complaint.

Corrective measures to resolved the inauthenticity issue

  1. We had deleted entire listing immediately . A removal order has been placed for all remaining inventory.

  2. Customer message have been promptly answered. We have initiated a full refund and apologized to customer for bad experience.

  3. To permanently resolved inauthenticity issue , we have now procured this product from authorized distributors named XXX Brand]. Invoice attached.

  4. We have stopped buying inventory from supplier who provided us inauthentic product.

  5. All listings, which authenticity cannot be verified with invoices and receipts have been completely deleted from my account’s inventory and will not be listed again.

How I will prevent this issue in future

  1. To compliance with Amazon Anti-Counterfeiting Policy requirement, we have changed our supplier and we have sourced this ASIN from one of the authorized distributors named XXX Brand]. Invoice is attached .

  2. Further, to meet Amazon Brand Name Policy, if any product requires any brand approval or authorization letter, we will get this first before mapping our offering to Brand listing.

  3. How I will verify supplier, I will obtain a list of authorized suppliers directly from the brand and purchase from those suppliers or distributors.

There’s a lack of some useful info and too much irrelevant info.

Reading between the lines i would guess you sourced a generic product from China and then found a listing for the product and either didn’t notice / didn’t care that the listing on Amazon had a brand name attached to it.

If that’s the case, then talk of anti-counterfeiting isn’t really relevant and neither is anything to do with your supplier. The fault would lie solely with you and your root cause would need to explain how and why you added yourself to that listing.

You haven’t decided to stop selling the ASIN, you’ve been kicked off the listing. Equally, reading Amazon’s brand name policy means nothing in this scenario.

If your supplier was in fact advertising “Nike socks” and instead sent “N1ke socks”, then your POA would still need to be quite different.
