FALSE BRANDING SOLUTION FROM AMAZON

I Just want to Whinge. I know its been talked about before but Amazons response was incredible.

I keep getting sent intellectual property complaints through Amazon from another seller, who basically have just been to the same wholesaler as me, and bought same products but have listed them on Amazon as their own brand, so when I am then selling that product, they don't like it and send a complaint.

My account health score has now dropped so low I'm at risk of having my account deactivated, I had the account insurance thing so Amazon rang me to discuss options.

1, ask brand owner for permission to sell - Der !! firstly the other seller is NOT the actual band owner, I have the actual owners permission to sell but because that is not the name the other seller have put in, it doesn't count.

If the other seller who Amazon say is the brand owner wanted to allow me to sell that product, they wouldn't have sent an intellectual property complaint.

2, create a complaint about the other Seller and Amazon will look into it (yeah yeah we've been through all that the last time they sent a load of complaints through and all Amazon said was there is nothing we can do if they created the listing in their brand name.

3, so option 3..... the Amazon guy, said ok so only way to improve your account health and keep your account open, is admit your at fault in selling their product, and the complaints will go away and your listings will be deactivated, so basically say I'm in the wrong when they are ones making false claims, then to relist your products ignoring AMAZON POLICY RULES - create new listings with either a made up barcode, or create as a generic product that wont ask for a barcode, and then claim it as your brand rather than the actual manufacturer, like the other seller has done, to protect the listings.

AMAZON that is illegal and then I would be as bad as other seller and actually infringing on the manufacturers intellectual property rights, and our customers deserve to know who is actually making the products not just who is selling them.

The correct approach for a Generic product is now to create your own Generic listing. That is Amazon policy.

Morally you may be correct but on Amazon by listing on your competitor's branded" listing - you are breaking Amazon rules.

My understanding of the system is, if you're self branding an item that is freely available to others then you must give that product your own bar code and your own packaging, and leave the rest to sell the product under the existing bar code that is on the item or packaging. If this is not happening they should be the ones booted off the listing.

Do the EAN's on the listing match the EAN's on the product?

There are a number of sellers who sell cards under their own brand. They are just selling well know brand names as you say but have rebranded it to their own brand name. In most cases they are using their own barcodes and not the manufacturer ones.

The trick is to search by barcode when listing an item and not to find a match by the picture. Also double check each listing before you add it to ensure that the brand is correct.

As for your current violations have you tried asking the other seller to remove the complaints so your account health restores to normal. Explain it is causing your account distress and that you won't list against their listings again. This might be the easiest option if the other seller is willing to do this.
