UPC issue (Proof of Affiliation)

Hello everybody! I share with you my pain for the last month or even a month and a half. I want to ask you for advice, and also to find out if this is a common issue.

I have a lot of experience selling products on Amazon and already have two created stores. I recently created a third store for my new LLC, registered a new brand "Mandy" (name changed), and so on. I prepared a new product, created a draft listing in my mind, and bought UPC codes. It was time to create a listing, but that's where the trouble came.

At the very end of the listing creation, when all the information had already been entered, error 8572 came out. After some experiments, I realized that it occurs when my brand and one of my UPC are placed together. If you use the Generic brand, everything is OK! The problem isn't with UPC.

I contacted support. I provided them with a ton of information about my LLC and my brand. Finally, after a lot of time, they requested Proof of Affiliation between the Brand and UPC owner. They wrote: "The proof should be signed by the Brand/Manufacturer/Parent brand which states that, UPC owner has permission to list the products of the brand with UPC “...”."

I thought that I would finally solve my problem. I provided Proof of Affiliation to Amazon support, but received a response which said it is invalid. The reason is very interesting: "Proof of Affiliation should come from brand/brand owner "Mandy" giving permission to the barcode owner to list Mandy brand products."

This is complete nonsense! Now they literally request that Mandy provide a Proof of Affiliation document allowing Mandy to list and sell products. How many people have faced similar problems lately? What can you advise me to do? My "conversation" with support on this topic has been going on for more than a month. I don't know what to do. Thank you!

What is the name of the Owner (REGISTRANT) on the USPTO site? Is it the EXACT same name as the owner of the Amazon account?

If it is NOT exactly the same you will need to show some proof that the two are the same. As I recall, I had to submit my LLC State Registration with MY name as the owner of the LLC since my Amazon account is under a different LLC name.

The OWNER of the Brand is the one that MUST enter into the Brand Registry agreement. If the owner is not the same as the Amazon seller the seller will have to be granted access by the owner.

In short, the seller support is correct when they mention: "Proof of Affiliation should come from brand/brand owner "Mandy" giving permission to the barcode owner to list Mandy brand products."

Let me clarify this below...

So, in your case, you has to prove that the brand owner “Mandy” (brand name matched with this post) know who “ex: Sally is (where you bought the UPC codes)” and that they know/acknowledge that they will be listing products using their own GTIN.

The Proof of Affiliation (PoA) needs to come from the brand itself, not from the seller. In short, this is to prevent catalog issues.

Please create a PoA that has this information and attach to the case ID. Let me know if you have questions.
