Counterfeit without a test buy - HELP
Hello,
I am in need of help, we have an item removed because a claim is made that the item is “counterfeit without a test buy”.
The item is not counterfeit and we resubmit invoice after invoice and it gets denied, we get stuck on the endless “cut and paste” response loop from SS. (Although the same invoice was considered valid and ok for missing item reimbursement claims prior).
The person who made this false claim, is not a real person and the person certainly doesn’t have any rights to assert ownership of the said product to make this claim in the beginning.
Additionally just the “categorization” of “counterfeit without a test buy” is obviously flawed to begin with, as this party has never bought or seen our product, to say it’s counterfeit to begin with.
Any advice? I only have the invoice from the legitimate distributor of the item and Amz won’t accept it. Thanks.

Yes the trademark is on both the listing and product and other sellers are selling on Amazon.
No I do not express permission to sell it on Amazon. However if a) the company themselves was making the claim, I wouldn’t have an issue or b) the claim was made for “sales without permission” I wouldn’t have an issue. BUT our product is certainly not counterfeit.

- The invoices you are submitting should meet the below requirements in order to be accepted by the team:
- Invoices issued in the last 365 days
- Reflect sales volume during the last 365 days.
- Include contact information for supplier AND buyer, including name, phone number, address, and website
- File formats must meet either .pdf, .jpg, .png, or .gif files
- These documents must be authentic and unaltered.

What is the ASIN, so we can check.
Most likely it is a Chinese Seller, who registered a brand with Amz, and puts that brand in the title.
Even though a generic item, so, no brand actually on the item, nor no brand on the box. It is only the EAN barcode that is registered. Amz are always on that Sellers side.
This is why Amz is now full of generic items, all with so-called brands, as Chinese Sellers want only them on each listing, no other Sellers, so they control the price.
You would think against Amz policy, well it is, but Amz still support them as they registered the brand.
I bought 1 of these items myself this month, not even legal, nor safe, would electrocute someone, I have reported as a Buyer of the item, I spoke to Amz CS, and actually had someone in SA that understood me and the item has been removed from sale, after photos sent to them (unfortunately that so-called brand has many other items though, which I can tell are like to be as unsafe)

Looking again at some of these cat toys, they mostly have the ‘GiGwi’ brand printed on the box or product, yet they then have another ‘brand’ (such as vealind, rosewood, suhacco, alanek, petgeek etc etc) added over the top of that (and yet another ASIN to match).
The whole thing is bonkers and is helping turn the Amazon catalogue into a laughing stock.
It’s like a giant hall of mirrors and must be turning away a lot of buyers.
I for one often give up in frustration when trying to make sense of Amazon’s increasingly convoluted and absurdly overcrowded catalogue.
Creating a new ‘brand’ for every generic bit of Chinese tat might be a practical short-term solution for sellers but long term, it’s likely to destroy the goose that lays the golden eggs.

Hey We are having the same issue. Other sellers are claiming they own the product. They should not be allowed to claim items as their own brand when it’s not.
This is a dirty tactic from the seller as they can take over the market make lots of money and also a way of not letting anyone else sell the same product as them.
Also When you call Amazon they don’t have a clue and tell you to re submit the information. Now it’s come to a point no ones is even replying. Amazon really need to sort this issue out. No wonder the company is worth millions We know have a de activated account for two weeks and resolution. No company ever leaves a customer with out a resolution like Amazon

We are fighting two violations of the same nature. We only list our products via EAN and here we have a company claiming that they own the brand when they purchase from the same importer/manufacturer as ourselves. They have created the listing using the manufacturers details (including the barcode that is on the actual product). How can they claim that other sellers have a counterfeit item without a test buy? They have nothing to base their claim on and Amazon is siding with them. So frustrating. I have submitted an invoice an awaiting a reply from Amazon. From trading on Amazon over the past 10 years the only way to get these removed is if the person who has submitted claim retracts it.
