I'm residing in Spain - DAC7
Dear Amazon Seller Community,
I am resident in Spain, and I am creating an LLC in USA with which I am going to operate in Amazon.com
I do not want to have problems complying with the DAC7, my question is: in addition to having the LLC in USA, I have to be self-employed or SL company in Spain ?
Thanks so much.

RHi @Seller_TOYp0fmYPgx1m,
I understand you're trying to figure out the DAC7 requirements for your situation. Let me share what I found in the help pages.
Since you have a primary address in Spain, DAC7 will apply to your sales through the US LLC. As mentioned in the "DAC7 frequently asked questions" section at this help page: "DAC7 affects sellers with a primary address in the EU, irrespective of the store that they sell in."
If you generate €2,000 or more in sales or have 30+ transactions in a calendar year, you'll need to provide Amazon with information about your business entity. The "What information must I provide to Amazon?" section lists these requirements:
- Company legal name
- Primary address
- EU Tax Identification Numbers
- VAT identification number (if available)
- Company registration number
- Any permanent establishments in the EU
One important thing to note - once Amazon sends their first notification, you'll have 60 days to provide this information to avoid account deactivation.
Regarding whether you need to be self-employed or have an SL in Spain alongside your US LLC - this goes beyond Amazon's DAC7 requirements. I'd recommend checking with a tax advisor who can look at your specific situation and help ensure you're properly set up in both countries.
You can find all the detailed DAC7 reporting requirements here: DAC7 Reporting Requirements
Hope this helps provide some clarity!
Best regards, Michael
