Selling branded items as new

Hello,

I have a quick question regarding selling items as 'New' when purchased from a wholesaler or even a local retailer. I see many people doing retail and online arbitrage but have never done it myself and don't want to take any risks here.

If the product is purchased from a reputable shop (say Tesco for example) and sealed in perfect condition with no defects, and you're ungated (or don't require approval), can it be listed as 'New'?

Amazon policy states:

'In order for your inventory to be sold as New on Amazon, it must arrive at the fulfilment centre in a good condition and without defects.

Products listed as "New"

Items sold as "New" need to be in brand new, unused condition.'

However, I have heard of Amazon suspending accounts over authenticity claims where the seller can't provide an official letter from the brand or licensed distributor that they are allowed to sell the product or guarantee its authenticity, despite it clearly being a genuine product.

Can someone please clarify Amazon's position when listing items as 'New'?

Some people get away with it for a while. They tend to be the same people who six months later are screaming on the forums that Amazon has withheld their funds and charged them for destroying their inventory.

Amazon's view of 'authentic' is a supply chain that leads back to the manufacturer or at least their authorised wholesaler so will at some point ask for an invoice to prove this. If the items have come from retail they maybe destroyed. If you've bought from a middleman they ask for their invoice as well as your own. If Amazon cannot see a supply chain for the right number of products leading back to the manufacturer they will deem the products 'inauthentic'.

Personally I don't think the system is perfect, anyone could buy genuine products to sell through their own channels and send an equal number of counterfeits to Amazon. It always amazes me that Amazon don't ask for invoices before accepting/clearing goods into FBA. They seem to leave themselves open to chancers.
