Rejected Brand Registry

Brand application has been rejected due to ”Your Brand Registry enrollment application has been rejected. Why did this happen? This decision was made since we could not verify the registered business name and business identifier (e.g. tax ID number or business ID number) provided by you at the time submitting the Brand Registry enrollment form.” please help!

!. You must register YOUR brand, with YOUR USTPO Registration, in YOUR brand Name, and if your account name is not the same, you should have a TA on your legal documents showing you are the actual owner.

My name is Sandy from the Community manager team. @CR_Amazon has asked me to review your Brand Registry case.

I have a number of reasons why your case could have been declined.

First addressing your Business Verification question, please visit this post I have made: Brand Registry Business Verification issues? Here’s the 101 the reason I posted this is because we have had many seller questions around them. So you are not alone.

Looking into your application details, you mentioned that Elm & Em**** LLC is your business name per official records. However on the trademark the owner is showing as an individual name (P.S) I am including only initials for security reasons. As stated in my post, the reason could be #2. The business information provided in the application does not match what is reflected in the trademark.

Second, looking at your brand application, your brand name you applied with is Elm & Embers Skin Care. However this is not what is shown on the trademark. (missing EE at the end) Applications for brands need to match what is EXACTLY listed on the trademark. Even the slightest difference will get you declined.

Third, on your trademark I see you have 0 - UNKNOWN MARK DRAWING TYPE. This Trademark type is NOT accepted and Brand Registry needs to either have trademark types 1-6 as mentioned on this help page under Trademark type. Please also see the post Brand Registry Design mark vs Word mark which explains this in detail.

I know this was a lot of information and perhaps more to unpack than the business verification issue, but I hope it was helpful. As for next steps I would advise you to do the following.

1. Contact the USPTO to change to a valid trademark type.

2. Once the trademark type is changed, apply again with the SAME brand name on the trademark.

3. When entering business information please make sure the information is accurate and what is represented on the trademark.
