Amazon Deactivated my Account over a false counterfeit claim- Item not even delivered
I've sold over 1000 items FBM over the past 2 months on Amazon.
I added one new product, which I got from a distributor, and listed it for sale.
Got my first sale for this item, shipped it out, and in less than 12 hours my account was disabled due to "counterfeit item".
The client didn't even receive the item, yet, these claims got my account suspended entirely. This bogus claim has caused my current income to fall to $0.
I've cooperated with Amazon by supplying invoices, packing slips, and even my suppliers packing slip from the actualy manufacturer! The item was in the manufacturer's packaging. I've done everything by the book to avoid getting Amazon against me, yet, they seemed to have terminated me for now.
This is extremely frustrating, and also stressing as Amazon is currently my only source of income.
If an account moderator has the chance to possibly look into my situation I'd be grately thankful.
I don't care if I cannot list that brand, however, having the ability to continue with my other listings will allow me to get back my monthly income and essentially, my one and only job.
Best regards,

Your supplier's invoice from the manufacturer doesn't do you any good if you do not have the brand's permission. Any item that you sell that is branded will probably meet the same fate.

Pay CLOSE attention to what @TVOI50told you.
More and more brands have provided a "whitelist" of their approved sellers and if YOU are NOT on the list you will be stopped in your tracks and probably hit with an IP violation.
Are you authorized IN WRITING by the BRAND to sell their items on Amazon? That means from the BRAND, not some random wholesale source that can NOT authorize anything – they only SELL.
In addition, have you verified with the BRAND that your source is AUTHORIZED to distribute the products? When people say ' a distributor' it leaves a lot of questions about authorized or not.

Hello @wholesale_central
Thank you for the information regarding the violation you are encountering. You should have received a performance notification that includes the detail regarding the requirements that would be needed to address the violation. For counterfeit violations, we do look for the invoices for the product to be submitted. As a reminder of the requirements, I have included some of them below.
- Must be dated within and reflect the sales volume for the previous 365 days
- Must include both your information as well as your suppliers
- Must include the product with price being the only variable that can be excluded
- Outside of price, the document should be unaltered and readable
For more detail regarding our sourcing requirements, check out this page. If there are any discrepancies or our team is unable to verify your information, the document will get rejected.
If you have any additional questions or concerns, continue to refer here for additional guidance.

Did you stop to consider that the person you are buying from is selling counterfeit items.

If what you say is accurate, it seems like this should be resolved in your favor. If the item is legitimate - not counterfeit - seems that this would be a simple fix!

Is your distributor Alibaba by any chance?

Join the club of bogus claims. Yes Amazon has designed violation that carry no merit requirements for brands to restrict trade and control brand competition and if they just plain don't like your face.

IF the issue is u sold an actual branded product from disty that bought it from the brand and number have the chain of custody invoices to the brand..then I have a pre-made template that got me reinstated 5 years ago when Jarrow supplements knowingly lied on claims even when the authentic item was in their hands.

The reality is that the brand may have made the claim against you at or about the time the order was placed. The buyer may have had absolutely nothing to do with it.
As most have stated, the brand can make these claims against you and Amazon is going to side with them immediately. The burden to prove your product is authentic is on you, not the brand. Amazon allows you to list anything with the assumption you have sourced the product as required.
In the current environment, sellers should make a habit of checking with the brand to determine if they require sellers to be authorized to sell their products on Amazon. Also find out if you have to purchase directly from them or if an authorized distributor is sufficient.
Ignore all of the comments about policy and what other sellers believe is fair or supported by law. Amazon is well aware of both and you can be guaranteed they are ready to defend any claims a seller makes against them. Protect yourself and your investment by knowing what you are getting into before jumping in.
This is Amazon's pool. We are merely guests that they can do without.
