New account deactivated “Section 3 of Amazon’s Business Solutions Agreement"

Hi Team,
Last week I registered my selling account on Amazon and yesterday I received a notification from the Amazon performance team as below. I need your help to reinstate my account.

"
In accordance with Section 3 of Amazon’s Business Solutions Agreement, your Amazon Seller account has been temporarily deactivated. Your listings have been removed. Funds will not be transferred to you but will be held in your account while we work with you to address the following issue.

Why is this happening?
You have listed items under a brand that you are not approved to sell. This is a violation of our policies. There are pre-approval requirements to sell the brand listed below. In order to ensure that customers can shop with confidence on Amazon, we may require sellers to obtain additional approval to list certain products and brands.
---------------------------------------- —.
How do I reactivate my account?
To reactivate your selling account, please send us the following information:

  1. Copies of invoices or receipts from your supplier issued in the last 365 days for the ASINs listed below
    – These documents should reflect your sales volume during the last 365 days.
    – Please include contact information for your supplier, including name, phone number, address, and website. We may contact your supplier to verify the documents. We will maintain the confidentiality of your supplier contact information.
    – You may remove pricing information, but the rest of the document must be visible. For ease of our review, you may highlight or circle the ASIN(s) under review.

  2. A plan of action that explains:
    – The issue(s) that you believe caused the above policy violation to occur.
    – The actions you have taken to resolve the issue(s) that caused the above policy violation to occur.
    – The steps you have taken to prevent future policy violations from occurring.

Not entirely sure what help your asking for.
It’s quite clear what the issue is, you listed something that you were not approved to sell.
So you need to provide evidence that you actually were.

You then need to provide a POA that explains why it happened, what you have done about it and why it won’t happen again.

As Neil says, that email is very clear.

There are many brands and categories of goods that you need approval/permission to sell on Amazon - there is a list somewhere in the help pages.

I really appreciate your contribution. I need your help with the POA. Kindly review and suggest the required modifications.

Dear Amazon Product Compliance Team,

Thank you for providing us with the opportunity to send you a Plan of Action for listed items under a brand that you are not approved to sell.

What went wrong:

  • We uploaded a bulk ‘loader listing’ from an OTC supplier without checking over for restricted brands, this file contained a restricted product. We did not audit these listing which were uploaded using inventory feeds.

  • We failed to read the Amazon guidelines regarding brand restriction on Amazon.co.uk and thus listed items under a brand that not approved to sell.

  • We take full responsibility for this issue and understand that if we list goods on Amazon, we are responsible for ensuring that our listings comply with all laws, regulations, and Amazon policies.

What I have done to fix the issue.

  • We immediately removed the prohibited brand that are not approved to sell and moved to analyses our other listings to ensure their compliance with Amazon policies as well as applicable laws.

  • We have thoroughly reviewed all Amazon policies, guidelines and help pages, especially Amazon’s restricted product policies.

  • After reading the lists of prohibited products, we went through our entire inventory and removed any items that may have been in a violation of the Amazon policies, restrictions or applicable laws.

What I will do to prevent this from happening again:

  • Before listing any further items on Amazon, we will consult with our on-product quality insurance team and verify that product’s Brand is approved for sale and compliant with Amazon policies and applicable laws.

  • We have put a system in place whereby our product quality Assurance Team checks all potential listing before they are listed on Amazon, this will ensure that we never list a prohibited Brand again.

  • After reading the restricted brand I went through my entire inventory together with a product quality assurance team and removed any item that have been any violation with the Amazon policies, restriction and applicable laws.

  • To help us make sure that we do not violate any policies, we will also ensure that if using an inventory loader or automated system in future, we will ensure to check all these listings whilst liaising with our product Quality assurance team.

  • We will regularly review and analyses the Amazon policies to monitor changes in laws and regulations, especially from the MHRA, to ensure we can immediately take-action and proactively remove any potentially prohibited listings on time.

    • Any products that has not been verified 100%, will not be listed.
    • We have informed our suppliers, that they should not supply us with products that have prescription ingredients, and any items that are in question in compliance with amazon policies.

CONCLUSION:

I take full responsibility for the satisfaction of Amazon’s customers. We never sold any of the mentioned products hence no buyer or brand complaint. As such, we respectfully request that Amazon reinstate our selling privileges.
