I have registered a trademark with the USPTO through IP Accelerator and subsequently enrolled in the Amazon Brand Registry. However, I received a response stating that my brand is already registered on Amazon. Upon searching for my brand name on Amazon, I discovered another brand with the same name, albeit selling different products. According to the USPTO, we have registered under completely different classes.
This situation has posed a significant problem for us. Our products have already been produced with our brand name, and a considerable amount of resources have been invested. It would be highly frustrating if we were required to change our brand name and potentially lose all the resources we have dedicated to building it. How can we solve this?
See below reply from Brand Registry team:
"I would like to inform you that we are unable to approve your application to the Amazon Brand Registry.
Your Brand Registry application has been declined as we have identified the trademark from your application as related to a brand that is already enrolled in Brand Registry.
To access the enrolled brand, we recommend that you contact the brand administrator who may add you to the enrolled brand as an authorized user and may also add any additional trademarks to the brand's profile.
Please apply again in the future if you have additional information. Also, please understand that once the application gets declined it cannot get un-decline and you will have to re-apply with all the required documents."
