Unlawful infringement of intellectual property rights

I have a problem with a product. I have been selling it on Amazon for 8 months and it has become a popular product in recent months. But recently I received a complaint from Amazon that I am infringing someone's patent.

I only have the plaintiff's email, but he is not responding to find out what exactly I am infringing.

For Amazon, my receipts that I buy the product on Alibaba are not enough. They deleted my product page and my account is at risk.

Has anyone encountered such a problem? Thank you.

Hey,

Sorry to hear about this but in the eyes of Amazon there is an infringement.

Amazon do not see Alibaba as a distributor, they see them as an intermediary between buyers and sellers.

If the ASIN that you have listed against is Branded then you would need a LOA and/or invoices from the Brand/Distributor to prove the items you are selling are what you claimed them to be.

In the Infringement Notification email from Amazon it should tell you exactly what information they want from you.

Hi

I am experiencing the same thing with a PL product that I sell. Someone made a baseless claim that it infringes their design (without any evidence), Amazon simply deactivated my listing and asking me for LOA which I cannot provide as it is not the product of the claimant. Sorry to hear about this but in the eyes of Amazon there is an infringement.

Amazon do not see Alibaba as a distributor, they see them as an intermediary between buyers and sellers.

If the ASIN that you have listed against is Branded then you would need a LOA and/or invoices from the Brand/Distributor to prove the items you are selling are what you claimed them to be.

In the Infringement Notification email from Amazon it should tell you exactly what information they want from you.
