Yet another Amazon rash decision costing its sellers potentally thousands of pounds (Lintbells)

Dear Amazon.

I am needing a issue sorted out asap.

I have been a seller with you for a number of years and in that time I have experienced various challenges along the way but nothing like tonight!

I was in for a surprise tonight when I started receiving dozens of refund initiated emails. I worked out this will cost my business thousands for no wrong doing on my part.

I heard the other day that Lintbells issued a statement regarding the selling of counterfeit items and that it strongly recommended that people do not buy from third party sellers. I had a chat with amazon about this today as it seems very unfair to long standing sellers who abide by your policies regarding counterfeit items etc to suddenly be restricted from listings. As a business we all make purchasing decisions based on current markets and as user of Amazon for my business it would be nice to know that you have my back and that I am not suddenly going to be kicked off a listing and told I can no longer sell these items.

Regarding tonight. What has happened! I am shocked to see dozens of refund emails.... for what reason? I can only assume it is in response to the public status regarding the recent events and there by Amazon wants to be seen in the right for refunding all its customers. This is very wrong as for businesses like myself I can provide documents to prove that all my stock was infact genuine original and not counterfeit. By refunding my customers you have not only put me in a great amount of difficultiy through no fault of my own but also you have given my customers the question of well was my item counterfeit as it has been refunded. The refunds should not have been issed to anyone as to date no recall has been issued by lintbells so I am holding you responsibly to refunding all my refunded orders. I also wish to note that no refunds from my purchases has been given! So I am also down the cost of every product you have refunded.

I have attached a legal letter to a case on seller support and I would be grateful if you could follow this up in a timely manner without the need for me to take this further.

Selling on amazon has become a bit of a burden at times as I am sure many will agree. We are all feeling on edge selling on your platform. There seems to be little to no backing for your sellers favouring customers basically 99% of the time from scams to damaged items and negligence of items returned. Its all a bit of a joke when you consider just how much fees we pay you for the privilege to use your platform.

Please get this issue resolved asap.

I’m in the same scenario as hundreds of other sellers, staring down the barrel of a multiple six-figure loss.

It’s completely unlawful how Amazon has handled this situation.

I expect to be reimbursed as a matter of urgency, along with every other legitimate seller that has been unfairly impacted by this

Well done Amazon, another situation where sellers lose out. What would help is if you vetted your sellers and stopped unlawful people selling fakes on your platform. With the thousands of people who legitimately sell legitimate products on your platform. You have allowed Chinese sellers to flog fake products. Completely an amazon issue and you've made small businesses lose millions of pounds collectively. If not resolved, me and many others will be taking legal action to resolve.

I am in the same situation.

Amazon cannot be allowed to have this both ways.

I bought my stock direct from Amazon and have invoices to account for every single unit sold or barred from being sold that is now being recalled.

Either, Amazon doesn't need to refund me because their stock is authentic = they should not be refunding customers that purchased my orders since my stock is authentic.

Or,

Amazon is saying to my customers that the items were not authentic = I bought my stock from Amazon which I can prove via an A2A invoice = Amazon needs to refund me as well.

They can't have this both ways.

Deeply disappointing and a very stressful situation for all of us to find ourselves in.

Amazon support have not been assuring or helpful at all when this has been brought to them.

In fact Amazon has refunded absulutely Yumove orders to all my customers even those that was not mentioned by Yumove / Lintels.

- A number of responses on this thread state that you purchased from amazon and then resold on amazon. Sadly, it is common on these forums that there are issues with this business model - as you are purchasing retail and selling as New. The product, once purchased from Amazon is not new - it is second hand and could only be listed as Used ON AMAZON (if indeed this product could even be listed as Used).

- The issue you will now have - and you will need to approach this via legal action I imagine, not on a forum or via seller support is amazon UK don't accept their own invoices to show the items you were selling were a valid supply chain. This is because any warranty or protection for the product ended at the point you purchased the product from amazon. Amazon are clearly working with YuMove who will have a list of valid suppliers that sellers could have purchased legitimate YuMove products from to sell. Amazon themselves won't I imagine be on that list.

- You might also want to discuss this with your insurance provider (as has been noted on another thread) though again, where they would stand on the business model of selling retail goods, I wouldn't be able to say.

Looking back to the Kinder surprise issue several years ago it appears Amazon did make good the refunds charged to sellers after the issue was raised by journalist Katie Morley in the Telegraph. I'm not sure that counts as a precident in this case as this isn't a product recall but a manufacturer warning people to only buy through authorised channels.

Amazon have decided to refund all customers who have bought from third party sellers when not obliged to by law as they would be with a manufacturer recall so collective legal action against Amazon seems the best chance of recource.
