Ultimately, it depends on what you uncover by doing a test buy from this Seller. Is the actual product being sold by this seller your actual branded product, a copy/counterfeit or an Intellectual property infringement like Trademark or Patent infringement.

If this is your actual product, Amazon cannot enforce and here is why:

"Exclusive Distribution (except in China, France, and the United Arab Emirates) – Amazon does not enforce exclusive distribution rights except within the countries that have laws specifically referring to selective or exclusive distribution."
