So I create a brand and amazon fails to help counterfeit sellers ruining my business

I have spoken to Seller support this morning and they have asked me to document my issues.

On the 16th June 2020 I created a case whereby I requested to list my new premium product

Amazon granted this permission after I had sent Photographs of my product showing my branding please see images below.

All was great, and we began advertising our product increasing our advertising spend daily and built our brand up to where it is now (Currently number 4 in its category ) which we are very proud of.

I was however extremely shocked to find that another 4 sellers have now piggy backed onto my listing and is selling a cheaper counterfeit product under the guise of my brand.

I reported the issue immediately,

I have attached official proof from the UK Intellectual Property Office of my current UK trademark Application

As this seller is now selling an inferior product without our consent we feel that their product is confusingly and deceptively similar to our product.

As our consent to use our Trade Mark was neither sought nor granted they are in breach of both our trademark and our common law rights.

My next concern is that the offender has undercut my price and now all of my paid advertising campaigns have now paused because I am apparently no longer in the buy box.

I cannot drop my price as this will devalue the brand we have spent so much time, money and effort building up.

Please can someone look into this as we feel this is totally unfair and a blatant flouting and disregard of the Amazon rules and policies.

I’m currently in the same boat.

Have 3 sellers on the listing created for our branded product.

Only issue was at the time of creation i listed the brand incorrectly so got it changed to correct it. Brand registry are throwing that back in our face as an excuse.

Let me know if you have any luck. I’ve filed multiple complaints on brand registry with no luck.

the whole amazon branding feature is a total joke! We have some of our FBA inventory now stranding due to us using our own brand on our own (manufactured by us) products. Obviously, talking to SS about this issue didn’t bring any sensible outcome… the system is getting worse and worse with every day. There is no one to talk to who understands how things work. They keep forwarding cases between teams and no one have a clue on how to deal with anything.

We went through the same thing but then enrolled in Amazon transparency. It seems to work really well and we have had all other sellers removed because as the brand owners we are the only ones able to approve them for transparency, which of course we didn’t do (although one cheeky one actually contacted us demanding the transparency labels from us…) Amazon notifies them directly that they cant sell the product without our approval and our labels. I would strongly recommend getting onto it as this is the only way to stop others abusing your brand. The transparency folk were really helpful in getting us all set up, now if anyone tries to sell counterfeits of our product without our unique transparency labels Amazon blocks them either as seller fulfilled or FBA.

Buy 1 unit from all of those piggyback sellers and message them something like this:

Dear, “PIGGYBACK SELLER”,
• “BRAND” is trademarked by us under UK IPO having trademark # UK###########
• We are also brand registered for “BRAND” on Amazon
• You’re selling a product that is trademarked by “BRAND” (us) and hence, we’re now expecting a product that is trademarked by “BRAND” (us)
• As per our knowledge, you’ve never bought from us so if we receive a counterfeit (parallel import) or generic product, we’ll report you to Amazon for rights infringement
• Otherwise, if you knew you were doing this, I am a seller too and I am willing to let all of this go. I will not file a complaint against you on Amazon, if you decide to remove your offer from our product’s ASIN within the next 24 hours.
• Looking forward to a prompt reply.

agree, it’s a joke. Genuine brands that sellers have invested time and effort in promoting getting hijacked and on the opposite end of the spectrum, people abusing brand registry to put branded items into a mailer bag with a different logo. Akin to putting an iphone into a bag with a banana logo and telling amazon It’s a banana phone but still advertising it as an apple phone. There needs to be a better system to report abuse.
