Is this Return Policy Wrong?
I am not looking to grass anyone up, but I found this return policy with one of our competitors and it has got me thinking about how I handle my returns. This is theirs:
"8 Day return policy
If for any reason you change your mind about your purchase, you can return it to us in its original condition within 8 days of the date you received the item. The delivery should be unopened, with all wrapping, seals and any shrink wrap still intact for us to issue a full refund for the price you paid for the item. Please note that this does not include any postage costs incurred for the transaction. Also if the parcel is returned due to the carrier unable to deliver the goods after the two scheduled deliveries and its not collected before the 5th day from the spa of the second scheduled delivery this too will incurred a £6.48 charge that will be taken from the refund . We can only accept the return of opened items if they are faulty.
Return postage costs for unwanted items are the responsibility of the customer.
Incorrect item received
Should for any reason you receive the wrong item please contact us within 3 working days. It is our policy to send the correct item once the wrong item has been received back and we will be responsible for subsequent postage costs.
Faulty Items
Provided the product is within its warranty period, we will at our expense arrange the return of the product and send replacement goods within 1 working day of receiving the return.
Faulty items within 28 days of purchase may be replaced if in stock or refunded if out of stock.
For Technology Products you may be referred to the manufacturer for product specific advise or Diagnosis.
Outside the 28 days, faulty items need to be directed to the manufacturer to exercise your warranty.
In accordance with Amazons return policies, returns and refunds on Large items will not be accepted after 14 days."
The bits that I think are wrong are:
8 Days policy? - What is that about?
We can only accept the return of opened items if they are faulty. - I thought you can return items opened whether used or not within 30 days?
In accordance with Amazons return policies, returns and refunds on Large items will not be accepted after 14 days - News to me?
If they are correct, then this could change how I do mine and I will be more profitable lol
Thanks

The terms offered that you quote are illegal under UK/EU law, Consumer law allows buyers to cancel an order within 14 days from the date received and a further 14 days to return, so anything less is breaking Consumer law.
Then we have Amazon return policy which exceeds buyers rights, this is the returns policy that all sellers are required to offer as a minimum and which is communicated to buyers, so any terms not complying with either the law, or Amazon policies are irrelevant and not enforceable.
Normally an A-Z claim would quickly resolve any disputes.
Don’t attempt to replicate stupid returns policies, it will at some point backfire.

Yes it is - minimum should be in line with distance selling regulation

It’s a shame as I would love to turn down returns of open boxed items

As far as I see it
- Their 8-day rule is against both CCR regs and Amazon policy and is a figment of their imagination
- They cannot hold back any monies from a refund except; where goods are devalued by either the customers rough handling or overuse
- They cannot insist that an item is unopened (unless it’s media etc) as a buyer has the right to open, handle, inspect and try the goods as they might in a retail outlet. Certain items are none returnable according to CCR but Amazon may still allow them.
- They cannot insist the goods are returned to the manufacturer, they can suggest it i.e. to save time on transit, but the buyer has the right to return to sender and receive the shipping costs within certain timeframes.
- Amazon runs a 30-day returns policy no matter what size the item is
