Our competitor is using our trademark with reckless abandon, but our trademark abuse claim is in "Not Accepted" status.
We have had Brand Registry protection on our trademark "Flueblocker" since 2020, and in the last month (Oct 2024) we have a new competitor ASIN: B0DGKMS26M that is misusing our trademark flagrantly on their title, link, description, and bullets.
I have filed Complaint ID: 16564583231on brand registry under our registered Flueblocker brand, but the status is "Not Accepted". The reason given is "We are unable to retrieve the status of this notice at this time and our team is working towards fixing this issue. We apologize for the inconvenience caused. "
So I opened another case: 16580219251 that is now under review.
This is a pretty clear case of misuse of my principal wordmark. The competitor is using it capitalized in dozens of ways in their text, both separated and unseparated. I don't really understand what the holdup would be? Has anyone elese experienced this?
