ASIN(s) suppression due to safety and/or non-compliance issue(s - ADVISE PLEASE

We have received the below notification from Amazon.

The item that they are relating to is a confectionary item.

Amazon have removed the listing from Amazon for ALL sellers (not just us) so we can’t add a new offering on the listing as it no longer exists.

I have contacted SS who have advised that we need to request reinstatement but we can only request it once and we can’t request it until a removal order has been completed (we had 400 units available at FBA & 4 in transfer) so I’m assuming that we can’t request it for the next 30 days?

Amazon haven’t said why this has happened other than it’s been ‘recalled’ but the manufacturer hasn’t listed ANY recalls for their items. We already attach a label containing all the mandatory info (BBE, ingredients, nutrition info, manufacturer contact, weight and title).

Any ideas as I’m stumped as to what the issue is since it’s affected all listings and do you think that we may be able to get it reinstated as seller fulfilled whilst FBA remove all the stock as it was a VERY popular line and we have over £5k in stock in it at present?

Your product(s) has been removed from sale due to a potential safety and/or non-compliance issue.

Note: All pending customer orders will be cancelled, and you should not seek to ship any pending orders for this product yourself.

How do I reinstate my products?

In order for the reinstatement request to be considered, we need to receive the following evidence as a minimum:

For food products (food and food supplements):

• Images of product labelling showing all mandatory labelling requirements or a PDF document showing the full compliant product label; and

• Confirmation that the detail page information is in line with the product labelling.

For non-food products:

• Declaration of Conformity (DoC) if applicable to the product/Proof of registration with CPNP (if cosmetic);

• Test reports to back up the DoC;

• Images of the product and packaging showing all mandatory markings and labels; and

• Copy of the user manual

How do I send the required information?

Any appeal of this decision will be handled via a reinstatement request. Contact Seller Support on how to initiate the reinstatement process. All relevant documentation can be submitted via Seller Support.

What happens next?

If you do not send the requested information, your products will remain unsellable.

If you are a Fulfilment by Amazon (FBA) seller, you will be temporarily unable to create a removal order for the affected product(s) for a period of 30 days. After 30 days, create a removal order in Seller Central to arrange for the removal or disposal of any affected product(s) in our Fulfilment Centres. If you are unable to create a removal order after 30 days, contact Seller Support for assistance. The remaining stock will automatically be disposed after 60 days of being unsellable.

We remind you that you are responsible for the products you list on the Amazon.co.uk marketplace, and for complying with our policies and all applicable laws. You will not be penalised for the first-time removal of these listings. However, we prohibit re-listing of the affected product(s) on the Amazon.co.uk marketplace. Note that further listing of these affected product(s) on the Amazon.co.uk marketplace may result in the removal of your selling privileges.

Amazon will not give legal or compliance support beyond the help pages already published. I can relate as something similar happened to me too.

I tried to list a soft toy by a well known brand. I was listing as seller fulfilled. I got an email similar to yours saying the item did not have the required safety tags/certificates. I thought this strange as it was a well known brand and when I checked it did have the correct labelling.

I contacted CS who wanted photos, documentation, certificates etc. As I was not the manufacturer I obviously could only supply photos of the tag which I did. In the meantime I contacted the manufacturer. They replied the item had never been recalled and had all the relevant certificates. They were aware of the situation on Amazon but it was an Amazon issue and they had been trying to get it sorted with Amazon but whoever they contacted kept passing the buck.

Anyway after several weeks and supplying and then re-supplying pictures of the tags CS accepted that the item had the relevant safety standards. However, they said that all FBA sellers had to first remove any existing stock from the warehouse and had been given 30 days to do so. After this period I would be able to re-list.

I waited 40 days to make sure then re-listed.

The next day I had an email saying the item had been removed as it did not have the relevant safety certificates!!

I re-opened the case with support and then realised that even though I had been told it was removed - actually it had not. It was active.

So, in answer to your questions:

  1. It looks like you will have to remove any FBA stock first
  2. In the meantime you won’t be able to list as seller fulfilled until Amazon accept there is nothing wrong
  3. Once they do accept there is nothing wrong, I would first list as seller fulfilled to make sure - and then, and only then, perhaps after waiting for a couple of weeks to make sure, would I send back as FBA
