Account Suspended due to IP violation, submitted 11 appeals, no luck so far

Hey all,
I’ve been dealing with a issue for the last three months – my account got suspended because of IP violation related to counterfeit item. I’ve already submitted 11 appeals, but no luck so far. I gave it another shot on May 1st, but once again, I got that same generic message saying I didn’t include some missing info. I was planning to give it another go in a week or so, but then on May 5th, I got a very new type of message from Amazon.

Thank you for your recent submission. It has been reviewed and accepted. However, your account remains deactivated at this time.

Why is this happening?
Due to unresolved policy violations from the following dates, we are unable to reactive your account. The dates are in YYYY-MM-DD format:
– 2023-02-12
– 2023-03-07

So, on May 10th, I submitted another appeal to Amazon. Basically, I told them that our account health has zero policy violations and positive health across all marketplaces. I even attached proof to demonstrate this. but received the same generic response. now i don’t have any clue what should i do. I mistakenly downgraded my professional plan after my account was deactivated. So now, I can’t even contact account health or seller support. That’s why I’m reaching out on this forum – it’s my only way to get in touch with some one who can help me out. I’m really hoping to sort this out soon.

Hi, are you able to submit appeals or is that also not possible?

Have you got a detailed root cause section, detailed corrective action section and preventative measures where you reference links to policies relevant to your particular suspension? You also need to provide a detailed business model as to how you source goods all the way through to selling. Your appeal needs to be quite comprehensive, 3-5 pages long.

You will need to figure out how to get your account upgraded so you can contact Amazon following your appeal submissions to understand what is missing from your appeal.

You need to post the original notification and asin

Was it counterfeit ?

Did you list on correct asin ?

Did you submit any invoices - or just appeals?

Looking at your username and feedback, are you items allowed to be sold in UK - as you are in US ?

Hi @Therese_Home_Remedie

This is Aksh from Amazon, here to assist you with your concerns.

From the above post we understand that you have concerns regarding the Intellectual property violations resulting in the deactivation of your account.

We would like to let you know that Amazon is dedicated to ensuring that products on its marketplaces do not violate or infringe a Rights Owner’s intellectual property (IP) rights. Rights Owners can report infringing content they find on Amazon and share answers to frequently asked questions on how Amazon handles infringement complaints. A Rights Owner includes any person (such as a brand, a seller, a customer or any third party) who legitimately owns intellectual property rights for the product in question.

To learn more about intellectual property rights, please visit your local intellectual property office.

If you have an established relationship with the rights owner who submitted the complaint (license, manufacturing or distribution agreement, etc.), we encourage you to reach out to the rights owner and request that the complaint be retracted. If we receive a retraction from the rights owner, your content may be reinstated. The rights owner’s contact information is provided in the warning you received.

If you believe that a rights owner, or Amazon, made an error when removing your product listing, reply to the notification you received and provide specific reasons as to why you believe a mistake was made. Provide any invoice or Order ID that demonstrates the authenticity of the product, where appropriate. We will then re-evaluate the notice and your content may be reinstated.

Amazon does not enforce distribution channel control reports or check for a seller’s authorization or ability to sell a brand’s products through the infringement form. If you report counterfeit on the basis that a seller is not authorized by you to sell or, you have not allowed other sellers to sell your product, it may not constitute an infringement complaint.

Also, we would like to thank @TheDeansOfficeCo and @The_Little_Shop for their proactive guidance on the issue in hand. We would recommend you to follow their suggestions while drafting your appeal.

Kindly post on the same thread for any further assistance. We are here to help you.

Regards,
Aksh.

Knowing a little about Microsoft Licensing from when working for a large reseller in a previous life and having a relative who is currently a Microsoft Reseller both in US and UK, they will not back down, all products both digital and physical are region based and the resale is strictly controlled if you purchase MS product you are tied to a contract which permits where and how you can sell that product and that is not transferable so if you purchased liquidation stock you are considered the end user not a reseller and resale is considered Grey Market which contravenes Microsoft’s Licensing & Trademarks, in the really old days you would see copies of Windows 3.11 - 95 which were identical to Microsoft including the media but the only mention of Microsoft was “Compatible with” a loophole they eventually closed.

@LCAWEI I just come across a forum post you made about a year ago regarding an issue that seems to be affecting my account now. I’m curious to know if you were able to get your account reactivated and, if so, I would really appreciate it if you could share how you managed to resolve the situation. Your help would mean a lot to me. Thank you so much in advance for any information you can provide!
