£240 order, Returned Empty Package, What Can I Do?

Hi everyone,

I recently had a buyer return an item worth £240, but when I received the return today, the package was completely empty.

I originally shipped the item in a box because the item is electrical , but the buyer returned it in a padded envelope.

The flap was open upon arrival, meaning the item could have been removed in transit.

The return weight was 373g, which is close to the expected weight, but the actual contents were missing.

I have taken photos as evidence, showing the open mailer and return label.

Has anyone dealt with this before? What’s the best way to fight this kind of fraudulent return? Im worried as this is alot of money.

Hi, looking through your post something seems amiss with me.

You said the buyer took your parcel to the post office and they weighed it at 375g which was the expected weight, the post office would have weighed it obviously meaning they had a 375g parcel handed to them, your customer would not see the parcel again after that point.

Did you recieve a 375g parel back? If not then the RM must have something to do with the missing contents I think?

I see your reference to return postage weight.

Did they take to a post office or perhaps add label via click and drop or another method where you self-declare weight?

If post office or they have proof of posting with weight, then maybe something happened afterwards. However we use C&D and the label has the weight we enter, which is not verified.

Sorry if I get this wrong as @Seller_hf3WAIwfSX840says how could this be buyer fault please? Because you claim you received the parcel with flap open, empty. Would the post-office accept any parcel with flap open? And after weighing and presumably paying as the weight shows on it, are we allowed to take it back from the counter and go away?

I think the buyer has to receive a full refund or there is the risk of an A-Z hit on your account and SAFE-T claim being denied. I don't think Amazon would accept that your receiving the parcel with flap open is buyer fault.

It may be a case that there has been some fraudulent activity since it was an empty packaging but there is no plausible evidence that buyer removed it and sent it empty. The way Amazon would see it is that just as you accuse buyer of removing it, the same could be assumed of your claim too.

My postie always knocks my door, hands over open or torn parcels and says that I have a right to refuse delivery and return, alternatively put in a claim. He never leaves torn or disfigured envelopes in my "safe place", he makes sure it is handed over. I would have thought all posties do this. Had your postie done the same, you could have refused delivery and asked your buyer to lodge a claim when it returns to them, however you accepted the "flap opened empty parcel".

I am sorry, it is all not adding up for me.

I did some research into how Amazon allegedly protects marketplace sellers.

I found one example where Amazon took three people in Spain to court for repeated violations of false INR claims (That was because they were scamming Amazon)

I have found no evidence at all of where Amazon has taken anyone to court for scamming a Marketplace Seller.
