Hi guys , we received this email from Amazon a couple of weeks ago. Basically we had ran out of stock of 1 item , so rather than cancelling the orders , we sent the customer the exact same product but with our manufacturers branding on , instead of ours
We are 100% FBM and apart from these 2 occasions, we never do any drop shipping. We’ve appealed this 4 times including invoices from our supplier , bank statements to prove we are paying these invoices, a spreadsheet with hundred of orders including date they were sold , tracking codes etc. We have spoken to seller support before our most recent appeal who advised us to go into more detail into the root of cause and what actions we have made to prevent this happening again
We’re just wondering what the chances are of us being reinstated, given we have only done this twice and certainly won’t be doing it again

Almost all violations can be successfully appealed provided you say the right things.
Do you know how Amazon found this out about those x 2 orders which were Drop Shipped? Maybe you sent a message to the customer and mentioned they were being Drop shipped by your supplier?
I cannot see that you were drop-shipping, as Amazon see it (eg Buying from another retailer and getting them to send it to your Buyer).
You buy from the manufacturer already, and they sent the product that you purchased, so your stock, to the Buyer, on your behalf.
I assume they should have either not sent a packing slip, or they should have included a blank one. It would have been best if you emailed the manufacturer your Amazon packing slip and included that with the order.
If the maker included their invoice to you with the order and showed your lower trade price, that is maybe the issue, so you need to address that in your appeal, that you will ensure in the future where the maker is shipping your stock, you will ensure only your paperwork is included. A letter from the manufacturer acknowleding this may help your appeal.
If no invoice or packing slip from the maker, then again put that in writing from the maker to you, then raise as an appeal, saying you have an agreement that only your paperwork will be included where the maker ships your stock to a Buyer.
Amazon have not said it is about selling a different item, so I would not raise that, as just causes separate issues. However, maybe if you run out, get a next day delivery to you, relabel the product if it is identical anyway. Or arrange that with the manufacturer, so then no issues.

It's a good question. Perhaps they saw something different with how these orders were being despatched, for example the tracking was showing them as being sent from a different location.
Mostly it is better to just cancel orders if you have no stock. Provided you shift enough volume one or two cancellations make no difference the only problem would be potential negative feedback.
In this case, it's not exactly dropshipping. You're selling the same products but under a different brand, which the manufacturer doesn't seem to object to. Unless you're a major brand like Versace or Nike, it’s unlikely that customers would notice or care. However, I’d be curious to know how Amazon discovered this. So today we received our balance that Amazon were holding back until they had finished their investigation. Our seller fulfilled offers are still deactivated at present though. Will this mean we are being reinstated, now they have released our funds? It has been 30 days, today since they deactivated the account
It's hard to believe Amazon would suspend you for a single dropship order. It's also difficult to see how they would have found out.
I say this because there are dozens of sellers on Amazon who (as far as it is possible to tell) do nothing but illicit dropship all day and everyday.
It is rife in the books category - I (like many others) get regular orders from overseas based sellers who list millions of cloned ASINs that they do not physically stock. They also (obviously) have no proper agreement to use me and other sellers to dropship their orders.
Even without special access to Amazon's internal system I can spot their listings a mile away...but Amazon bots seem blind to their shenanigans.
Yet you get punished for a single 'infraction' of the rules.
Or are Amazon suddenly getting tough with 'illicit' dropshipping?
