Account Deactivated in accordance with Section 3, Authenticity concerns

My account was deactivated suddenly on October 31, 2024 due to authenticity concerns and in accordance with section 3. We have not had any Product Authenticity Customer Complaints for the ASIN that is causing the misunderstanding. We do not have invoices for this ASIN as only a few items were purchased from large chain retailer to do a sales test. We have have taken immediate action and steps to ensure authenticity of products we purchase moving forward. We submitted an appeal yesterday but it was rejected because we lacked invoices for the ASIN causing this issue. Any advice would be greatly appreciated.

You need invoices to prove authenticity and supply chain. Buying from a big box retailer was your first mistake and last mistake, as Amazon most likely will have you deactivated for life.

Yep, you're done. Amazon has been quite clear that the ONLY way to resolve any sort of IP complaint is to provide proper documentation, including full supply chain. You do not have this, as you have only a receipt.

Sadly, you're too late. Amazon wants sellers to do it right the first time.

There is no advice that can be offered, at least not in regards to your Amazon account. Without proper invoices, there is no way forward here.

And right there is where you made your error, and it may be a FATAL Error.

You knowingly listed, or joined a listing for product that you did not have valid documentation to submit if/when demanded.

While Amazon does allow a path to recovery for a Suspended Seller account, the reinstatement entirely depends on the Seller submitting a "Plan of Action", explaining the how the incident occurred, but how exactly the Seller can prevent re-occurrence.

From what I have read on this Forum, I believe that Amazon will not accept a simple "Mea Culpa" and a promise to not do it again. Amazon is (rightfully) concerned about potential lawsuits, and requires valid documentation to prove a legal chain of custody and legal origin of manufacturing.

For this reason, Amazon seems to have adopted a "No Tolerance" Policy which does not allow for a "Mulligan" the first time you are caught.

A Seller who is challenged for IP Violation MUST be able to provide such documentation to be Reinstated.

You clearly stated you did not acquire this product through an approved source, so you can NEVER provide the documentation that Amazon is requiring of you.

On it's face, it appears that you are done here.

If your Amazon Seller account is verifiably worth a great deal of money to you, then perhaps hiring outside legal counsel may be a way forward, but it will be expensive, and has no guarantee of success. Apparently there is an entire legal cottage industry of attorneys who claim to "Specialize" in reinstating Suspended Amazon Seller Accounts.

But like I said, it will be expensive, and has no guarantee of success.

Wherever you go next, be SURE to understand the Rules and to NOT break them. This will be a very expensive lesson for you, even IF you can somehow be reinstated, so the least you can do is learn from you mistake.

Does anyone else find it funny how this OP is not even telling the whole truth? Who buys an item from a retailer to test as a wholesale item? I have never bought 1 of the 11000 items i offer at a retail chain to test sell.

what does that even mean? you bought at $50 to sell at $50? (scalping aside) and then when it sold you were going to take that $35 and buy more?

I had the same issues too my account was deactivated last in July 2024 due to authenticity concerns and in accordance with section 3. my stock was Zero i I was trying to see I have permission to selle that product and go for purchased from large chain retailer to do a sales test. I have been tired of received appeal rejected.

You are most likely going to get suspended. Then you will be able to appeal the decision by writing a Plan of Action. You must take full responsibility for your mistakes and what you are going to do to ensure this will never happen again. If this letter does not get approved, then your best course of action is to hire one of the various amazon "attorneys" that specializes in this. That is going to probably cost between 3-5k

All of these youtubers, tiktokers, and deal groups are not correct about how to properly sell on Amazon. You might see videos of people making thousands by going to retailers and flipping but they will get deactivated eventually.

The only two ways to really sell on Amazon any more is through private label and wholesale. When you get your account back, never go with the Amazon targeted wholesalers. Their invoices will not be accepted.
