Account suspended Counterfeit

Hello.
We were informed and alerted to Amazon as it was selling fake by the list owner as we were unconscious at the time of the parekende arbitrage. Our account has now been suspended. We were normally on the list but no product sales were made. We got to this point as a result of a few emails. I added The Last email We received below.
We need to explain this to Amazon right now. I need the support of Kika and other knowledgeable friends. Amazon doesn’t want a bill, it just wants me to explain it. 2. the article says what you did to solve your bogus problems. I need convincing sentences on this.

So, it looks like your Seller Account was suspended as a result of Intellectual Property Rights Infringement Complaints with the reason “Counterfeit”.

Just as the notice says, in order to appeal, you will need to provide Amazon a good Plan of Action (POA), in which you tell them what happened, how you addressed the issue and how will you prevent getting similar complaints in the future, regardless if you actually infringed or not.

It needs to be e-mailed directly to notice-dispute@amazon.com .

This should be easy, as most notices also require the proof of authenticity or a retraction notice, but you were only asked to submit a POA.

Here is an example appeal addressing this suspension type. You can use it when writing your own one but definitely don’t copy full sentences:

I sent the POA, making the arrangements you recommended, but it was not accepted. There’s a point I’ve been paying attention to. The previous Mail says " Greater detail on the actions you have taken to resolve Counterfeit issues’’ and the current Mail says " Greater detail on the actions you have taken to resolve issues.

Are they being consciously changed from the other side? or was it a coincidence?
or does it show that the PoA is incomplete and needs to be completed?
What kind of path should we follow

I understand that Amazon takes complaints of trademarks or rights holders about infringement of intellectual property rights very seriously, and I would like to share my action plan with you, explaining what I do to solve the problem and what I will do to avoid similar complaints in the future.

The main reasons for the violation, Why did this happen?

We take inventory from multiple suppliers, some large and some small businesses. In addition to creating some lists ourselves, we often match the product lists offered by our suppliers and the lists they have created in Amazon.

We share our responsibility with our suppliers to ensure that the inventory list and amazon lists we take from our suppliers do not cause any infringement. In order to prevent any infringement, we provide our own methods of checking before uploading to our inventory.

But last January and February, during the eligibility checks of the supplier lists that we uploaded to our inventory, we caused rights holders to claim rights in more than one ASIN we missed.

We reviewed each of the ASINs that caused all notices of infringement, and found that the current issue on the lists was lists that were regulated in violation of Amazon’s intellectual property policies or protected by the eligible owner who was not eligible for sale in the Amazon market.

We know that we must respect the intellectual property rights of rights holders and we accept our responsibility here.

The actions I take to solve the problems;

  • We spoke on the phone with the brands we can reach from the right holders in the notification and gave information about the situation. They were reluctant to withdraw their complaints, thinking they might have given us permission, but agreed that they understood our situation and were not intentional.

  • I removed the entire list of products from my inventory, which I received from the supplier that caused us problems. I also decided not to take inventory from this supplier again. I found that these products are not suitable for sale on Amazon even if they are not a problem on other platforms.-

  • 2 assistants will work with us full-time to create work lists for new products and to check for existing supplier lists.

  • When selecting our suppliers, it is expected that it will be a priority for us to be a manufacturer and to have an original specification suitable for general sales in Amazon.

  • I have ’examined’ the ’reasons of violation’ ’in the infringement notices and made the necessary arrangements to ensure that my entire inventory complies with Amazon’s intellectual property policies.

The measures I have taken and will take in order not to repeat the problems in the future;

  • Before listing new products for sale in Amazon, I will verify that the products or lists do not infringe anyone’s intellectual property, trademarks, copyrights or patents.

          How will I do;
    

a - If there are no existing lists of suppliers in Amazon, we will create lists for each product.

b - If there is a listing, we will be able to filter the preventive in cases where it is above words and brands with the software of our developer company in order to reach our enginnter established on this subject.

c - In other visual and labor-intensive controls, our assistants will spend more overtime and provide continuous supervision.Thus, if there are situations that can cause rights violations, it will be determined before uploading to inventory.

  • In the following process, our attitude to cooperate with manufacturers (Brand owners) and authorized distributors will be at the forefront. This will prevent completely unauthorized sales.

  • I also know that I have to resolve timely policy alerts that may affect my account and deepen issues, and I will continue to adhere to amazon policies.
