Reporting other sellers

Reporting other sellers

We are the brand registered owners of a brand but have other sellers that are currently on the listing. Is there a way to have amazon reach out to these sellers and tell them that they need to stop selling? We understand that we can report a violation but we recently started back on Amazon and we don't want to file an IP Claim on these other sellers since they have been on there during our absence, but we do want them removed now. The products they are selling are valid but we do not want any other sellers selling our products on Amazon.

Also, as a second question, If we were to report them, in this case would we select copyright infringement, patent infringement or trademark infringement?

Does that mean that they are really selling your brand, your product? And if I understand well, it was not YOU who created the listing but someone of those sellers?

I want to share some background information about the Amazon platform so there are no misconceptions here: When a product detail page is created, it becomes a permanent catalog page on Amazon that will remain even if the creator's inventory sells out. Additionally, when you add your copyrighted image to a product detail page, you grant Amazon and its affiliates a non-exclusive, worldwide, royalty-free, perpetual, irrevocable right to exercise all rights of publicity over the material.

Other sellers can list their items for sale against pages or copyrighted images that you have used. However, we do require sellers to list only against product detail pages that exactly match their items. If you believe sellers are listing against product detail pages that do not exactly match their items, we ask that you complete a test buy of the product to obtain proof of a violation occurring.

Amazon respects a manufacturer's right to enter into exclusive distribution agreements for its products. However, violations of such agreements do not constitute intellectual property rights infringement. As the enforcement of these agreements is a matter between the manufacturer and the retailers, it would not be appropriate for Amazon to assist in enforcement activities.
