Seizure of FBA inventory

We have been an authorized seller of All-Clad cookware for nearly two decades. We have a formal letter of authorization from All-Clad specifically permitting us to sell their products on the Amazon platform.

Recently, our pre-existing FBA inventory was flagged and subsequently seized due to the absence of Transparency codes. The ASIN in question, however, was not enrolled in the Transparency program at the time the affected units were sent to Amazon. In fact: On June 23, 2024, we created and shipped additional inventory under the same ASIN, and no Transparency codes were required during the shipment creation process.

On June 27, 2024, we received a performance notification stating the absence of Transparency codes on pre-existing FBA inventory. We were told that the transparency codes for this particular ASIN took effect on June 25th.

We understand that Amazon takes product authenticity seriously, and we fully support their efforts to maintain marketplace integrity. This, however, appears to be a misalignment with non implementation of the transparency program on this specific ASIN when the shipments were created.

We were later informed that Amazon would hold the inventory until proof of authenticity was submitted. Although All-Clad did not initially notify us that this ASIN was subject to the Transparency program, they have since acknowledged that this was their oversight.

To address this, we have submitted the following:

A current authorization letter from All-Clad, explicitly granting us selling rights on Amazon and listing the relevant ASINs.

A detailed wholesale corporate invoice that includes:

All-Clad and its parent company (the sole distributor of All-clad).

Contact information: name, phone number, fax number, contact person, and email address.

Our business name and address an Phone #

The specific ASIN and product details are reflective on the invoice.

A quantity exceeding the number of units sold.

A valid date within the last 365 days.

This is a wholesale invoice, not a store receipt.

However, The invoice was REJECTED within 24 hours

We have spoken with a Seller Performance representative who indicated that a BOL and proof of payment are being requested i.e. bank account record of sale . We are submitting these documents . However, I have a strange feeling that these documents will be declined

Now that they have initiated the transparency program with this particular ASIN our existing inventory does not have transparency codes.

Our key question:

If inventory was shipped to FBA prior to the ASIN being enrolled in the Transparency program, is it consistent with Amazon policy to seize this inventory and request additional authenticity verification retroactively?

Any insight from sellers would be greatly appreciated.

Thanks for reaching out. As you have approval from the brand to sell their products, I would ask them to add you to their Brand Registry, which will show Amazon that you are authorized to sell their items. If you can also get a letter from the stating that the items they sold you do not have transparency codes, that may help as well. As the Transparency Program is an FBA issue, I am going to have someone from the FBA team reach out to you in this post to see if they can assist you. In the meantime, please provide your seller support case ID regarding your FBA inventory.
