AMAZON ACCOUNT SUSPENDED - GERMAN VAT, OSS

Hello

We have received an email that our Amazon.de account has been blocked from selling and shipping goods due to our failure to declare participation in the OSS system and provide a VAT number by the deadline.

The exact content below:

"We have taken this measure because your German VAT identification number was not uploaded and verified by the deadline, or you failed to provide evidence that you opted in to Union One-Stop Shop (OSS) together with the VRN used for reporting OSS. Under German VAT legislation, online marketplaces must collect a German VAT identification number from selling partners who are required to be tax-registered in Germany.

A VAT number is valid when the business name and tax address are accurate and matching between the information entered in Seller Central and data stored in the German Federal Tax Authority’s database. For more information and recommended actions, please review the help page .

If you do not store inventory in Germany, you can alternatively meet your German tax obligations by opting in to OSS. You will need to provide evidence that you report your EU Business-to-Consumer cross border sales to Germany via One-Stop Shop and mark the VAT identification number in Seller Central used for OSS. An overview of all EU27 Member state OSS portals and contact details for each country can be found here ."

We have been in the OSS system for 2 years, our VAT number has been listed and verified for 2 years on our seller account, the data has not changed, and all declarations are systematically sent.

In order to unblock the account we have to provide the VAT No. and declare participation in OSS, because we do not store goods in Germany, however, all the data on our account is correctly stated all the time and we have nothing to add there.

Please help, has anyone had this situation and what could be the reason?

I will try to asist you with your case.

I regret to hear about your issues with the VAT requirements for the German marketplace.

You state that you do not store in Germany and have an active OSS.

Could you revise and confirm if everything in your account has also correctly been set to confirm this statement? Often, issues may occur if, for example, you have given a German return address for a customer in Germany, as this would be an indicator that you store returns in Germany.

VAT issues can also arise when there are discrepancies between your Tax information and the information you have registered with us under Identity and VAT information.

The following steps might help you find the issue that has caused your deactivation:

  • First, if you are using Fufillment by Amazon or have previously used it to ship and store your orders, check your Fulfilment by Amazon Settings and ensure you have not enabled Germany as a country to store your products.
  • You should also ensure nothing else here is enabled that might cause products to end up being stored in Germany (such as returned orders).
  • Second, for Fulfillment by Amazon, you should also check in your reports, if you ever stored products in Germany in the last 360 days. If inventory is currently still stored, please create a removal request.
  • Wether you are using Fufillment by Amazon or not, you should check you Shipping Settings and ensure both your delivery and/or return address are not in Germany.
  • You should also go to your Tax Settings and ensure all information is Accepted and correct. Please also check if the address linked to your Tax number here is correct, as discrepancies may also cause VAT issues.
  • Lastly, check your Identity Information under Account Info, to ensure that your business name and information are identical to the ones stated in your Tax information. If it is not, please make the necessary changes.

If, after following these steps, you haven't found an issue, I would advise that you contact our Account Health Department for further support:

  1. In your Seller Central click on the Help button.
  2. Under "Need More Help" select "Get Support"
  3. After that, you need to click the following: Selling on Amazon >Account Health> Reactivate your account>Get help with my appeal from Account Health Support
  4. Here, you will be able to describe your issue.
