Company saying to get off their listing

Hi was wondeirng if anyone can advise me

We have a product that we have been selling for years then suddenly a new company decided to sell the same item but made a separate lisitng for it under their brand.

Our sales slowed down so i also listed on their listing as they dont own the product they are only a reseller, they have now emailed us to state we are not allowed to sell on their listing as its their brand and they will report us to Amazon.

Is there any rule on why i cant list on their listing, their brand is no where on the product at all - just a reseller like us

If you look under the listing itself, it is listed as “Visit the SunVit-D3 Store”. So they obviously added it to the their own brand listing.
If this item shouldn’t be, which looking at it, it shouldn’t, then you need to report the listing as it is actually using the incorrect brand and is against Amazon’s rules.
I doubt to be honest you will get very far with it, as it’s only really the brand owner that will be able to report it properly.

Just in case, it’s possible, that they have an agreement with the brand owner to be the only supplier on Amazon. So do bear that in mind.
But frankly, I’d list on the original listing and forget about it, it’s not worth the hassle, unless you are selling mega amounts of this product.

If the listing states a brand then no, you may not use their listing.

The product should be branded as well as the listing, but often isn’t or is just on the packaging.

You shouldn’t be selling the same product on two listings - that is strictly against Amazon Ts and Cs.

So it really depends on how the new listing is created - if the listing has a brand on it and your product isn’t the brand, then no, you shouldn’t be listing on it.

A quick question in relation to this particular scenario. If a branded item has already been listed on Amazon UK, using the EAN, but currently with no offers, and then a new seller comes along and somehow creates the item on Amazon UK again, using their seller name as the brand, and puts it in the product title, is this against amazon policies?

I think some sellers are getting confused about brand.
You can have a similar looking products with different brand names, for example
Brand A: Do not offer good customer service, do not send orders on time and no help once product is paid for

Brand B selling same product as Brand A: Sends orders on time, In case of issues answers messages quickly, Offers next day service, Offers 30 day or longer refund policy, telephone support etc. Also advertise their products on Amazon.

The brand ownership isn’t about product looking same or its from the same manufacture.

The brand owner will not like it if it is also advertise them on Amazon and then someone else takes the profit. Other platforms allow you to make your own product page, same thing.

The attribute “brand” is often used by sellers to populate it with either their seller ID or some random word.

The fact they have put a word in the brand field doesn’t make it a “brand”. There are literally millions of listings left over from a time when this wasn’t monitored at all by Amazon.

However I would report and move on. Once you start trying to fix Amazon catalogue, you’ll quickly lose the will to live.

If the other seller has created a second ASIN for an identical item, which is what you say has happened, you need to speak to seller support to check that you are selling on the original ASIN. If the other seller does not own the brand and you can prove that, you can get their page taken down. Creating a duplicate ASIN of an identical product is a breach of Amazon’s policy and they love nothing more than to enforce it.
