Threat by a Seller via Buyer Message

Hi all,

I have received a message via Buyer Messaging that Remove the listing of ASIN. Initially he send message to remove listing with attachment in Chinese. I though he is a real buyer I asked him to please reply in English. He responded back with this message

Hello, dear seller friend! Please delete the above ASIN from the list as soon as possible. We have our own registered brand and sales rights. Your behavior has constituted infringement. Please deal with it and reply to us as soon as possible! Thanks!

I don't understand what's wrong with it. The ASIN is GENERIC. I have reported this through the same platform. But he has threaten that I will buy your product and complaint it with negative reviews. What should I do please help.

When you state this, are you saying that the brand name on the ASIN is "Generic"? Or are you saying that it's a generic product, which, while generic, might have a brand name on the ASIN?

For some reason, you blocked out the ASIN, so impossible to look for any issues. If you share the ASIN, people may be able to offer more or better advice.

Appears to me that it is listed under an Amazon registered brand name. The item might be generic, but he has added his own branding to it and in this case you would be wise to do exactly what he says. Remove the asin from this listing asap. You can set up your own listing WITH YOUR OWN BRAND NAME (not generic) and make your own sales on this product.

These guys are serious and will destroy your account if you list under their brand name.

This is not an issue I have faced, but reporting it to Amazon (def the right thing to do) will probably boomerang back at you sooner or later. Not sure about how it would work on a generic product, but you may have to prove you have permission from the manufacturer to sell it, or demonstrate it is not branded.

I would ask them for their United States Utility or Design Patent number in regards to infringement of their product. They are obviously bluffing. Create an Amazon Case for harrasment immediately.

Not at all true at all if the listing is actually under a branded name. I think the OP meant "the product is generic" not "the ASIN is generic".

ANYONE can purchase a generic product, then use their own branded packaging and list it under their own trademark, Amazon registered brand name and no one else can list on that particular listing as it would be shipped with incorrect branding so it would not be identical. If you attempt to put that persons branding on your packaging, it will be considered counterfeit.

Makes you wonder why he wiped off the ASIN on his screen shot if it just listed under "generic".

This is call private labeling.

It's when you buy a generic product and then label it brand "XXX"

You are selling the same generic product but the brand is different.

The seller owns the brand so you cannot sell on his listing. Technically, the item is different because the brand is not the same. Yes, the generic product is exactly the same but the brand is different. So you are infringing.

I strongly advise that you delete the listing before Amazon take action against your account.

When this happened to me and I reported the seller, Amazon did precisely nothing. A Chinese seller was demanding that I raise my price or he would do all the things mentioned in the threat you got. He also said he had someone on the inside at Amazon to help him remove my product. And that is exactly what happened. I would think it was a conspiracy theory or something if it didn't happen to me. I hope its different for you but my guess is that Amazon wont help you.
