Legal action advice against Amazon
Could anyone recommend me how to take legal action against Amazon because I have patiently waited 3 months and I think I have waited long enough? I haven’t received even a miserable update on my case since I sent my appeal.
Here is more information about my case in case anyone wants to check it out https://sellercentral.amazon.co.uk/forums/t/4-weeks-waiting-for-a-response/238568
Right now, I want to get my thousands of frozen funds back and leave this awful company that seems to forget their duty to provide a fair service to their client base.
I was wondering if anyone has had any experience suing Amazon and what is the best, and hopefully the least costly, way of getting my money back.
Thanks in advance

What are you planning to sue Amazon for?
You are a dropshipping company who was unable to provide invoices for the items that you listed.
All Amazon want is proof that you are selling authentic and authorized goods.
You have not got authorization from the various brands that you listed, and have no invoices, obviously, so this is why Amazon have frozen your funds, and rightly so.
Get the authorization letters send in an appropriate POA [to DE as advised since this is where your suspension began] and have your account unfrozen.
It’s not that hard.
If you can’t get letters of authorization then why should Amazon believe that you were advertising legitimate stock?
The fact that you made no sales on some of the ASIN’s is immaterial, you listed them for sale and that is sufficient to bring you under the microscope.

It would be very helpful to hear if any seller has had any experience fighting Amazon legally.
Or if you feel that the service they have provided you is illegal and you would like to join forces and get a lawsuit against them, please email me to {Moderator Edit (Jessica): e-mail address removed} if you would like to join me and fight for our rights.
We need to stop being bullied by Amazon, as I keep reading awful stories on these forums on how decent and honest businesses keep getting suspended or products being refunded for no reason and it really has to stop. I understand they are trying to fight a bigger problem with the amount of counterfeiting products in the market, but in the process they are damaging honest business and they need to be aware of this.

Contact a solicitor recommended by the Law Society which specialises in contract law and who has experience of claims against Amazon if your claim is above £5000. If it’s under make a claim through the Small Claims service.

Wait so the reason they suspended you is because you were selling products for which you couldn’t supply B2B invoices or a letter of authorisation from the brand that you are permitted to do drop shipping for their products?
I think that it will be very difficult to get a decent lawyer to take this on as it’ll be most difficult to win this one in any situation…
- Amazon (and other platforms as well as consumer safety organisations) would quite rightly want to know if your products are genuine & safe.
- Why have you not got a letter of authorisation for those brands? I have a couple of bulky / heavy items that brands ship for me directly on all my channels and I have for those got authorisation agreements as well as after sales agreements in case of problems with the item in place.

I deal with a lot of fashion brands and the fact is most don’t write letters of authorization.
I do not know about other markets but take for example the brand O’Neill I have an account with them, so I buy directly from them and they don’t provide letters of authorization, in fact when I requested one to show Amazon they just laughed (not in a bad way) as they never issued any letters to any of their re-sellers, same happened to K-Swiss, Skechers, Quikcsilver, Roxy, and so on and so on.
I work directly with them as I do with most, NOT all of the brands that I sell, some I buy them via wholesalers, etc so maybe some of you do have such letters but in my experience and in working with the brands themselves they don’t provide that so Amazon is asking me for something that I cannot provide.
Never had an issue with them in that sense but makes me think that they either do not know how things work in the real world or just want to make things difficult or have a system in place whereby if a brand complains then they can kick someone out.
