Selling Someone else's Brand on Amazon

Hi all, I am new here, barely opened my shop and already struggling.

I have got line of products that are 3M brand. The brand name is all over the actual products. I don’t understand the explanation on Amazon site (nor explanation I got from Amazon once I opened a case asking them to navigate me in this matter) on how to list my products in correct way. Hoping someone can explain in “human” , simpler language.

Basically, am I allowed to sell those 3M branded products on Amazon full stop or not?
If I am, how am I supposed to mark them in my listings under the “brand” section. If I add new listing and mark the product in brand section with the name of my shop, than I am able to proceed and save the listing, but than I am wondering if this is correct as it is not my brand at all. However, If I try to mark those products as “3M” in section “brand”, I get and error message: “Error! You are using UPCs, EANs, ISBNs, ASINs, or JAN codes that do not match the products you are trying to list. If you believe you have reached this message in error, please contact Seller Support.” and I am unable to save this new listing.

By the way, the products I have are not sold on Amazon yet, so I wanted to create new listings. I am kind of stuck. Really want to do things right, but it is confusing. I noticed some sellers use “3M” as a brand and some sellers use their own shop name as a brand. What is the right way of presenting those products and how to proceed. Any advice would be highly appreciated. THANK YOU!

Just to clarify, are you inputting the EANs and there’s no products coming up?
Seems weird that Amazon will give you the error message if those EANs are not already in use - perhaps try a different SKU?

This is a relatively straightforward matter. I presume you are selling NEW 3M products? You are only permitted to sell these products as new, if you have either a) invoices from the manufacturer or authorised distributor of these products or b) written authorisation from either the manufacturer or the authorised distributor to sell these products. If you have bought them from a wholesaler, the invoice from them is not sufficient for you to be able to sell. Problems with EAN’s like the ones you mention can be down to the manufacturer changing the EAN for the product. Perhaps you can expand a little further…though keep any personal information to yourself.

This error is displayed when you attempt to list a brand which is “locked down”, if you are able to get a letter of authorisation from 3M then you will be able to join the Amazon brand registry system as a registered reseller of that brand, which should also allow you to list new products from them.

If you are unable to obtain such a letter then in theory you can’t list that product, there is however a bit of a grey area you could try:
List the product without a brand (or if it doesn’t accept leaving it blank, use your own brand) and 0 stock level, then submit a case to seller support to request that the brand is corrected, indicate that you are unable to enter the correct brand in your inventory (otherwise they’ll ask you to do this first). It is
debatable as to whether or not this breaks Amazon’s listing policy, as the listing is not going live and as such hasn’t necessarily been listing with incorrect information, plus you’re making every attempt to make it as accurate as possible.
