Ive received the below message on Amazon, im pretty sure I know the answer but they are talking rubbish arnt they? For a start two of the listings show “Unique” branded confetti on the pictures. Shall I just ignore it or reply to them?

They emailed me before about a listing for generic sandwich boxes that they had put their brand name on, I removed my add as it was really poor seller. They have now sent me this one. They claim it is their brand but I suspect it isnt as I cant find any Shatchi confetti anywhere on the internet. Some of the pictures on the listings are of Unique (that is a brand of party products) confetti,

Currently the listing contain what I suspect is an incorrect brand. You should raise this with seller support directly to have the brand corrected according to whatever is written on the packaging.
the first Asin appears to be branded ‘unique’ which would be my starting point.
At present you cannot list against an item unless the brand you are listing matched the brand stated on the ASIN, even if the brand is wrong. You need to fix the ASIN first.

I have had a look at the product and images. One of the images shows the registered trademark as being "Unique " on the packaging so I am unsure as where the brand name Shatch comes from. The message you received has not been written by someone who is qualified in Intellectual Property Law.

I am brand registered with Amazon and recently noticed another seller on one of my listings selling something similar. I reported the matter and pointed out that we do not supply anyone else and have not given permission for anyone to sell our trademarked products.

Amazon respects a manufacturer’s right to enter into exclusive distribution agreements for its products. As the enforcement of these agreements is a matter between the manufacturer and the retailers, it would not be appropriate for Amazon to assist in enforcement activities.

Yes it wasnt very well written. Ive removed the listings as had only sold about 40 in the last 3 months for thes listings and didnt want to casue any hassle incase I was in the wrong.

Personally I would temporarily remove my offers. Then get the product team to change the listings.
If the EAN matches, a simple photo should be of the item with the EAN should be enough. Links to the manufacturers website etc help/
Once changed relist and message the original complainers back thanking them for pointing out the incorrect branding.

Unless the BRAND has been “BRAND REGISTERED” on Amazon, by the owner of the brand or trademark then ignore the threat.
Can I sell products from brands in Brand Registry?
Yes, you can. Brand Registry does not prevent sellers from offering products of that brand. Brand Registry protects the listing content, but it doesn’t restrict sellers from selling the product.
There is however, a separate program of brand gating which does restrict who can sell the brand. It enforces an application process which can require supplier invoices, an authorization letter and a substantial fee.
Also, Amazon may ask for evidence that the products you sell are authentic, such as supplier invoices. This may also restrict your ability to sell the product if you do not have invoices that meet Amazon’s strict criteria. Although this is connected with product authenticity, it is not a result of a brand being enrolled in Brand Registry.
