Can anyone help with my appeal?

We have a suspended account due to "trademark text manipulation". Below I have copied Amazon's latest appeal denial notice and our latest appeal which has been rejected. If anybody can help with advice on how to improve our appeal I would appreciate it.

This appeal addresses Complaint ID: 17445396731 and incorporates all guidance from your Account Health Support team, including the recent message from Tarun D.

We now provide a complete root cause breakdown, corrective actions, preventive measures, and supporting documentation as requested.

1. Root Cause – What Happened

From 2013 to 2024, our business sold custom engraved pet tags under the brand name “Wag-A-Tude Tags.” In early April 2025, we received an intellectual property complaint from the brand “wagatude,” which we later discovered had been registered as a trademark.

At the time, we did not understand the conflict between “Wag-A-Tude Tags” and “wagatude.” In response, we attempted to correct the listings by removing the word “wagatude” from product descriptions and replacing it with our own brand name, believing this would resolve the issue.

Unfortunately, this edit reintroduced the violation by continuing to reference a visually and phonetically similar name. Additionally:

Amazon auto-filled “Wag-A-Tude Tags” into the product titles based on our brand name

We were advised via phone to delete all listings, which we did

Amazon never explicitly told us "wagatude" was a registered mark — we found that out through our own research

We were also told via live chat that some repeated violations were due to listing translations and Spanish caching errors

Throughout the process, we made repeated attempts to follow Amazon’s guidance but received conflicting or incomplete instructions. While we take full responsibility for the violation and understand the seriousness of repeat IP policy breaches, we believe the above contributed to confusion and delay in fully resolving the issue.

Because all 37 ASINs were deleted, we no longer have access to their original titles or descriptions. However, based on how the violation occurred, we can confirm:

All ASINs used “Wag-A-Tude Tags” as the brand, which auto-populated into titles

Product descriptions previously included the word “wagatude”

In early April, we edited the descriptions by removing “wagatude” and mistakenly replacing it with “Wag-A-Tude Tags”

This reintroduced similarity and triggered a repeat policy violation

Issue: “Wagatude” replaced with “Wag-A-Tude Tags” in error

All similar ASINs followed this same update pattern

2. Actions Taken to Resolve the Violation

✅ All 37 ASINs listed in Complaint ID 17445396731 have been permanently deleted

✅ Our brand “Wag-A-Tude Tags” has been fully retired

✅ We have rebranded under “Marvin+Co” and confirmed no IP conflicts via USPTO and WIPO

✅ We have zero listings live across all marketplaces

✅ We submitted Case ID 17650840201 to report unrelated 3P listings using our old brand, which are out of our control

3. Preventive Measures Implemented

Trademark Verification Process

All new listings require USPTO/WIPO clearance for the brand and related terms

Trademark search logs and screenshots are retained internally

No listing proceeds without documented IP clearance

Listing Review Process

All product titles, descriptions, and backend keywords are reviewed manually

No references to other brands, variants, or similar phrasing are permitted

All images and text content must be original or fully licensed

Account Oversight & Responsibility

Lee Bancroft: Trademark verification, listing creation

Kimberly Roberts: Compliance check, audit approval

Listings are dual-reviewed before going live

Training & SOP

New listing SOP created and implemented April 2025

All listing creators (Lee and Kimberly) have reviewed Amazon’s IP policy

Ongoing quarterly reviews scheduled (1st of each quarter)

Monthly listing audits to confirm IP compliance (1st of every month)

5. Final Note

We understand Amazon’s Intellectual Property Policy fully and have built a compliant structure going forward. As a UK-based business, we have also submitted a formal complaint to the UK Competition and Markets Authority (Ref: CMAE2500437), documenting the procedural inconsistencies we’ve encountered throughout this process.
