My account is suspended, I can not get back my inventory and my account is still charged

Amazon suspended my account because I do not have VAT registered in UK. It is surprising that they allowed me to sell the products for about 1 year and after months of active sales they stoped my seller rights. With so long delay. Still I have substantial amount of goods in Amazon UK warehouse and I do not have acces to it. Part of the products in warehouse are related with wrong delivery - these goods are even not shown in my seller account inventory list, but wer returned back to Amazon by third party UK warehouse. The second part of the inventory are unsold goods and I can see them in my inventory list (FBA), but I can not make a removal order because the account is suspended.

Only response I receive from Amazon is to apply tax numberin UK. But, I really do not see the reason to make it if I will not continue sales in UK. I want the goods back and I will never will return to Amazon because the experience. I also downgraded my account, but Amazon keeps charging the fees. I received the feedback from Amazon support that the fees will not be charged after downgrade, but they still do. It seems for me that this is already some kind of scam model. Amazon keeps my goods, charges the fees and I do not have any access to the account.

I can not get access to the inventory that I own.
I can not get contact with Amazon to solve the issues - to get removal order or to understand where are the returned goods located. They do not answer. Also the messages are automatically marked as answered in the messages box.

  1. I can not complete the removal order because the account is suspended. These are completely different issues to access the goods I own and to obtain tax number. These issues are not linked together.
  2. I can not contact Amazon either. The only response is that as my account is suspended I can only submit reactivation application. But, the goods are in Amazon disposal and I am also charged the fees. I should have right to get help regarding any other issues also.

I need advice how to proceed?

I discontinued to sell the products in Amazon for already 6 months ago I have already downgraded the account. I do not want to get charged monthly and I am willing to remove any products from Amazon warehouse, but I can not, because my account is suspended and zero support. As I do not want to sell the products in Amazon anymore I do not want to apply tax number in UK either.

I need adequate responce all the following issues:

  1. Where are the returned goods related with incorrect delivery and removal order located and how I can see and handle them to place the removal order?
  2. How to place removal order for the existing goods visible in FBA inventory?
  3. What should I do regarding the montly fee cancellation?

Get registered for UK VAT. Regardless of the fact that you no longer intend to sell, you presumably may have an outstanding liability for the sales you made prior to suspension.

You will continue to accrue monthly fees as your goods are taking up space in Amazon’s warehouse. They won’t store them free of charge.

Amazon’s advice seems straightforward - they won’t let you take your stock until you get your account back into a positive status. That requires UK VAT registration. I can’t see another way around it.

Unfortunately you can’t, you have the pay the tax already due. Amazon will continue to charge you the monthly fee and not release your stock until the back tax is paid. You cannot just sell in the UK for a year then shut up shop and get away with not paying the tax due.

It is not Amazon’s responsibilty to ensure you are VAT & tax compliant in the UK, it is yours.

I think the VAT man may own a lot of it! It is not up to Amazon to solve the issues, it is up to you, you need to register for VAT and pay the 20% due on your sales for the past year.

In UK the total sales is very small, only £575,44. In DE the sales was somewhat bigger 2998,21 EUR in total. The inventory itself (6 pallets of toys) was/is located in Amazon UK warehouse.

The German sales are not VAT free. You will still have to pay HMRC for 1/6 of those. The countries have a reciprocity agreement up to a threshold (don’t recall the amount at this time, but it’s way above your sales). So, any Amazon sales for .co.uk, .de, .it, .es, and .fr all will have VAT due to HMRC.

On the other hand, you can deduct VAT that you paid for the inventory in the first place when you file your return.

Hang on surely he only needs to be VAT registered if he is meeting the UK VAT threshold which is £85k in turnover.

Yes you will be liable for VAT on the UK sales of £575.44 (less any VAT paid on related expenses including import VAT on the goods you imported if paid), if your company is non UK resident and your goods are stored in the UK. The DE sales are not liable for VAT if the goods are all stored in the UK and you have not reached the distance selling threshold in Germany which you haven’t if your sales were only €3000.00. If you register for UK VAT it sounds like you could clear the liability for under £100 so would make sense to do that and (hopefully) get your account reinstated. Good luck.
