branded products listed as trademarked
Hey everyone,
I'm having a bit of trouble with two listings that seem to be controlled by the same seller for ASINs B0C74VS329 and B0CSGF7GQX. Both are for Kraft Mac and Cheese, offered in 3 and 6 pack bundles of 206 grams each.
The seller trademarked "SMART BUNDLES" and used this to create these listings. I ran into an issue when I tried listing my products under these ASINs, receiving a "counterfeit without test buy" violation and a threat from the owner about a potential IP infringement claim.
This doesn’t make sense because the product is clearly branded by KRAFT, so it shouldn’t be restricted under any trademark law or Amazon policy. Yet, this seller has somehow managed to use the trademark to monopolize these listings.
Regarding the violations, I’ve already sent in invoices showing both ASINs are the same product to clear up the violations. The violation got removed for the 3 pack, but not for the 6 pack—they said my invoice didn't have enough info to reactivate my listing. How come it was enough for one but not the other?
Can anyone shed some light on how to handle this? Thanks!

unfortunately as the brand byline is SMART BUNDLES that is the brand Amazon is looking for on any invoice. The fact you got one OKed was more luck or incompetence on the part of seller support.
The seller who created the listing has used SMART BUNDLES brand to create a listing that only they can list on. Amazon won’t actually do any due diligence to check if the product being listed is actually a brand.
Sadly in amazon word, you are in far in the wrong, you should not be on the listing (though the listing should not exist on the first place)
In future do not touch listings where the brand byline does not match the brand itself. You’ve down the right thing copying in the mods, they are currently looking at this as it’s a massive issue (though has been for some time)
