Hello,
The disbursements of part or all your Amazon sales proceeds have been temporarily withheld in all stores you operate worldwide (excluding Amazon.in) until we agree upon how the EU VAT owed on your sales will be paid to Amazon. Additionally, your Fulfilment by Amazon (FBA) inventory may be temporarily blocked from removal, unless the funds withheld exceed your estimated liability. As a result, within 10 days, Amazon will begin to collect and remit VAT taxes on your future sales for goods delivered to EU customers.
Our preliminary assessment shows that Amazon is required to account for EUR 10434.84 VAT on your sales to EU customers to date. Please, note that this is preliminary VAT liability only and that we will inform you of your final assessment of VAT liability within 3 weeks of this notification. It may differ from the preliminary assessment above depending on the sales you make to customers in the EU during this period. Any differential between this preliminary assessment and final VAT liability will be directly reflected in your Seller Central account accordingly within 10 days of receiving the final liability.
You can continue selling on Amazon, but your Amazon sales proceeds will be temporarily ineligible for disbursement and any FBA inventory blocked from removal from this account, and any related accounts, until we agree upon how the EU VAT owed on your sales is paid to Amazon.
Why did this happen?
We must collect and remit VAT from non-EU established Selling Partners for the sales of goods delivered to customers in the EU. Based on a review of your account, we determined that you may not be EU established for VAT purposes. This may have resulted in inaccurate tax treatment on your sales under the VAT on eCommerce legislation (effective 1 July 2021 in EU). We leveraged a combination of automated means and expert human review to identify this issue and make this decision.
What actions do I need to take?
To address your preliminary VAT liability, email us at mdri-exec-escalations@amazon.co.uk from your Amazon Seller Central registered email address stating that you are willing to pay back the VAT owed to Amazon. We will reply within 48 hours with available payment options for the VAT due.
After the VAT due is paid back to Amazon, the disbursement of your Amazon sales proceeds will be released within 7 days, and will become available to you according to your normal payment cycle. Additionally, if your Fulfilment by Amazon (FBA) inventory was held, it will be available for removal within 48 hours.
How did Amazon determine the VAT due on my account?
Your VAT liability is based on the sales you have made to customers in the EU since 1 July 2021, for which VAT was not previously collected by Amazon.
If you would like more information as to how your VAT liability is calculated go to the Account Health page in your Seller Central account https://sellercentral-europe.amazon.com/performance/dashboard?ref=DR_pnotif_ahd-ban and follow the instructions from the banner you will find at the top of the page. This will include all sales to EU consumers during this period where Amazon did not withhold VAT previously.
What happens if I don’t take the required actions?
If you don’t follow the instructions above to get your disbursements released and do not pay historical VAT liability owed to Amazon, your disbursements will remain temporarily withheld. You may continue selling on Amazon, but your Amazon sales proceeds will remain temporarily ineligible for disbursement and any FBA inventory blocked from removal from your account(s), until VAT owed is paid to Amazon.
What if I already paid this VAT to the tax authorities?
The EU VAT on eCommerce legislation requires Amazon to collect and remit VAT to tax authorities on behalf of all sellers that are not established in the EU. In accordance with this legislation, Amazon will remit the VAT to EU tax authorities directly and recover this VAT amount from you. If you already paid your VAT for this period directly to EU tax authorities, you can work with your current tax advisor to re-claim this back from the appropriate tax authorities.

Was genau verstehst du da nicht? Du musst deinen Umsatzsteuer begleichen - da du das bisher wohl nie bezahlt hast...
Hallo Mirsad, wir haben eine ähnliche email erhalten. Es geht darum in welchem Land Deine Firma angemeldet ist. Wenn Du eine in der EU angemeldete Firma hast und ein Deutsche Mwst Nummer, dann hast Du wahrscheinlich die Mwst der Verkäufe direkt an das Finanzamt abgeführt.
Amazon hat aber seit einiger Zeit Firmen die z.B. in Estland angemeldet sind angeschrieben, und deren Status als 'Im Sinne der Mwst. als ein in der EU ansässiges Unternehmen' prüfen wollen. Hast Du soch eine mail bekommen vor der mail die Du gepostet hast?
Du bist da nicht der Einzige, ich bin in Kontakt mit 3-4 Deutschen Sellern die dieselbe mail erhalten haben. Wenn Du mir Deinen Fall genauer beschreibst, also wo die Firma angemeldet ist, und wurde bereits Mwst an das Finanzamt abgeführt, dann kann ich Dir gerne sagen wie weit wir bei dem Thema sind.
Die Sachlage ist etwas kontrovers, es gibt einige juristische Dinge zu klären. Aber wir sind dran!
