German Tax Certificate registration for UK based companies
Hello lovely people,
I have a question if anyone actually studied and better started of completed registration for VAT certificate in Germany.
As we know per news feed there is new requirement to register non German companies for German Tax Certificate.
Please advise and guide if you know process to help all of us avoid mistakes and speed up the process.

I need more details on this aswell it’s quite vague, you need a certificate to sell otherwise you MAY be prohibited to see and you should consult a tax advisor to see if your applicable for the certificate?
I would rather not sell in Germany if that is the case 99% of my sales come from the UK market

The headlines wasn’t quiet clear. Is the VAT registration only for those who want to sell to Germany customers? They made it sound as if everyone has to register for German VAT whether they sell to Germany customers or not.

Not exactly. This is an enforcement change on marketplaces similar to what happened in the UK.
Amazon are now jointly liable to ensure that sellers are compliant with German VAT law, which hasn’t changed.

So as a small seller (non VAT registered although self employed with an UTR as enforced by Amazon) I do not need to apply for this German VAT certificate? All items shipped by myself from the uk and a few from FBA. I have had some success in Germany since last March and it would be a shame to lose it. Any advice appreciated please - thanks!

If you sell in Germany as a Non-EU Company or on an Electronic Marketplace (EU Company or Non) you have to register for a German Tax Certificate by 1 March 2019 (it actually already started on 1 Jan 2019). If you do not want to sell in Germany then you do not have to register at all.

Yes they have not replied so far. We are registered for VAT in the UK and hold all stock in the UK. We are bellow the German threshold by quite a bit the plan was to “try” to grow sales there, however, looks like the only way we can get registered would be to send a few items to German FBA and get registered for VAT there. Not sure its worth it at the moment. So much uncertainty.

It just doesn’t answer the question as to why Amazon are actually claiming German tax legislation that is predominantly untrue (to my understanding). if Amazon came out and said… “yes, we are asking for a tax certificate REGARDLESS of the actual legislation” and/or “we acknowledge that it is not required by law but we will ask for it anyway”… then at least we would have clarification. This whole “we are required by law” nonsense is not needed.
