We’re currently dealing with a hijacker/unauthorized seller on one of our Amazon listings, and I’m hoping someone here can offer guidance on the best next steps.
Here’s our situation:
• Our product is fully protected under a registered U.S. trademark, and we’ve been Brand Registered on Amazon since 2023.
• We are the sole manufacturer of the product. It’s also covered under U.S. copyright protections, so there is no legitimate way this seller could have authentic units.
• We’ve made multiple attempts to contact the seller, and even sent a cease & desist letter—no luck. Instead, they’ve dropped their price even lower and seem to be digging in.
• We submitted a “Report a Violation” through Brand Registry for trademark infringement, but haven’t heard back yet.
• I also reached out directly to Brand Registry support, but the help was vague and unproductive.
• We’ve recently started enrolling the product into Amazon Transparency, but it’s still in process and not fully active yet.
Here’s where I’m stuck:
Do I need to actually order the product from this hijacker to prove it’s counterfeit? I’ve heard mixed advice about whether that’s required or helpful when it comes to escalation.
Has anyone successfully removed a hijacker under similar circumstances? Any advice on how to fast-track this or escalate it more effectively?
We’re doing everything by the book, but it feels like we’re being punished for playing fair. Any insights, experiences, or resources would be incredibly appreciated.
