Hijacker on our branded trademarked product

Hi, we are having trouble with a hijacker on our brand registered trademarked listing. He's selling fake products and we are getting complaints and 1 star reviews. This is a product designed to help people with pain, he's doing serious damage to our customers. We are an 8 figure DTC brand attempting to launch on Amazon, this is seriously hurting our launch. We tracked him down to New York and contacted him by phone to give him a cease and desist. He removed himself but snuck back on in the night. He is stealing thousands per day.

What can we do?

We have all this mans details, he's in NY.

Test buy NOW. Verify it's fake.

Once you have confirmed, do the following:

  1. Use Amazon Brand Registry/Seller Central support to report counterfeit goods sold by this seller
  2. Have your IP lawyer IMMEDIATELY upgrade the C&D to a demand letter.

If you really are an "8 figure DTC brand" and this person "is stealing thousands per day" you need to shut this person down PERMANENTLY, not just on Amazon, but everywhere else. This person will want to get rid of the counterfeit inventory through any channel, whether it's another platform or reselling it to a "wholesaler" who will start to dump it on Amazon all over again.

I would make the demand letter require any remaining inventory shipped to you at their expense so you can dispose of it properly, as well as the legal names and addresses of the people further up the pirated supply chain.

FYI, "hijacker" has a different meaning in Amazon seller circles than what you are describing here, which is pure piracy.
