How do i stop a chinese seller selling my private label item?
A Chinese seller has piggybacked my listing and is selling it themselves. This is a private label item, how do I stop this?

Have you any IP rights to the actual product you are selling, beyond a TM name, if not, then what is it you own that prevents others listing the same item?
If it’s not identical to your item, then you could make a test purchase from your competitor and provide evidence to Amazon of why it’s different to have them removed.

I had the same problem last year. I had a Trademark on my piggy backed product but at the time I didn’t have the TM’d brand registered with Amazon so Amazon provided no help whatsoever.
I ended up directly messaging the piggy backer informing them that the product is TM’d and that Amazon had been notified. In my case they quickly removed their listing. Give that a try. Good luck.

You can speak to your local trading standards office who offer a free service instead of having spend money on legal costs.
In the past we contacted our solicitors who drafted a template letter which we used for all trademark infringement claims.
Alternatively you can follow the Amazon reporting trademark infringement process.

How can they sell you own private label item without first buying it from you?
Perhaps they are selling an identical item sourced elsewhere or from the same supplier as yourself?

Well, having had the chance to read all the well-argued, moderate and respectful responses of the friendly contributors on this thread, I hope you are much clearer now.
I hope SemperArdens is right when he says “once these new Government rules regarding VAT kick in, a lot of the dodgy Chinese sellers will vanish”. It COULD make a big difference if Amazon polices this new law properly. After all, Amazon is sort of on probation at the moment if it wants to avoid being taxed on its UK turnover rather than its profits, as some Ministers are suggesting, so it might just be in its interests to crack down on Chinese FBA sellers. We’ll see.
