Listing Reinstated Finally
Evening all,
A month ago, I created a post on here after my listing was removed due fo a false intellectual property complaint.
I sought advice in my time of stress & panic on here and appreciate all the advice recieved.
Saying that I was told in no uncertain terms that there was “no way I was going to win this”, that I should apologise to Amazon and focus on account preservation, “Amazon will never accept chinese invoices as proof of authenticity”, “admit you’re never going to win this” etc. etc. etc…
Thankfully, my competitors and I knowing that the claim was invalid and was only submitted for competitive benefit rather than actual breach of intellectual property persevered.
After multiple appeals and solictor involvement, my listing was fully reinstated today . I honestly never expected it to be after everything I read and appreciate that the advice I had was probably correct for 90% of products.
What I would say if you are 100% sure you are not breaching anyone’s rights, don’t just give up and roll over. There are too many people trying to manipulate the system with design rights that are not only different to the designs they are supposedly breaching, but are usually registered on the EUIPO. The issue with the EUIPO is that designs are registered unchecked. Whether they can be legally enforced is a different matter.
Anyway, I’m so glad that I didn’t take the advice directly. If I had listened to the person that said, “I repeat, you’re never going to win this one”, I would have just given up.

Good job. More sellers should be willing to stand up to Amazon when they know they are in the right instead of instantly rolling over.
