Advice for appealing a Copyright Infringment

Hi,

This is our first post here. We’ve been selling on Amazon for about 10 years without a problem. The vast majority of the items we sell are plain, unbranded packaging

items and we also manufacture and sell our own cardboard boxes.

A few days ago we received a notification from Amazon that one of our products had been removed for a copyright violation and that our account was under review, though

we haven’t actually been suspended. The product in question was an unbranded pack of cable ties that we made a product page for pack in late 2016. At some point

between then and now, the product page was co-opted by another seller who changed the title, picture, brand etc. This completely flew under our radar until a few days

ago when the same seller lodged a copyright claim against us for this product and Amazon removed us from the product detail page.

As far as we understand it, copyright only applies to original works of authorship, not unbranded packaging materials.

We would like to try to appeal this claim as we feel it is unjustified but we are unsure as to how to present this to Amazon. Any advice would be greatly appreciated.

Abel here to assist.

In your case, the best way to appeal the decision is via Received Intellectual Property Complaints list on your Account Health Dashboard (AHD). Please check Performance -> Account Health and click on Received Intellectual Property Complaints.

To be able to appeal the decision, you need to click on “Appeal” button next to the related ASIN on the list, which will redirect you to the appropriate e-mail address to submit your appeal.

However, i recommend you to contact Seller Support to be able to solve the issue you have mentioned about the description of the item, before submitting your appeal.

The original Policy Warning notice which you received from Amazon regarding the matter should include all ways how you can dispute the specific complaint.

In most cases, you will be asked to provide this by e-mailing notice-dispute@amazon.co.uk

”– Proof of product authenticity (e.g., invoice, Order ID, licensing agreement, letter of authorization). It must clearly prove that your products do not infringe any intellectual property rights.“

Sometimes, Amazon will then still require you to provide them a Plan of Action, in which you tell them, how you will prevent receiving similar complaints in the future.

Or they will insist that the rights owner sends a retraction notice, which includes your merchant token to notice-dispute@amazon.co.uk.

Without more details, it’s difficult to advise.
