Root Cause POA - Counterfeit Goods

In error I listed the product I had on the wrong listing and as such the brand owner for the listing I listed against submitted an IP claim resulting in my account being suspended due to counterfeit.
I immediately deleted the products and listings when I realised and tried contact the rights owner to explain but I don’t any response.
Amazon are saying I need greater detail within my root cause, but not sure what else to add to the following, which I already think is too long?

We infringed the intellectual property rights of another seller because we did not obtain pre-approval from the owner to use their private label, or trademarked brand. We listed products under ASIN: B077SKGD3H instead of ASIN: B00BEVCQLK and as a result, products were not accurately described against the correct ASIN assigned to it. It was an overlook on our part, as both products were similar and we apologise for our error.
We apologise for offering products without license or authorisation agreement and we have deleted all reported ASINs from our Inventory Page. Please see our detailed plan of action below that outlines each of the measures we have enforced to prevent similar issues to ensure that our future product detail pages comply with Amazon’s Intellectual Property Rights Policy.

Your other problem is screwfix are not a wholesalers so if you were selling an item New bought from there you wouldn’t be providing a valid invoice for the goods (in Amazon’s eyes)

Did you not see the other listing, or did you pick the one with the higher price? Not much return on an £11.99 item bought from retail if you use the correct listing which is around £18-20 whereas the other seems to have been around £35.

The issue with your root cause is that you’ve not really said why you did what you did. That’s what Amazon want to see.

Then as mentioned you are risking a lot with retail arbitrage.

Thanks for sending the appeal which you have already submitted. I understand that your amazon.co.uk account has been taken down for Intellectual Property violations and you want recommendation from our end in reactivating the account.

For every brand, you need to take prior approval from the brand owner/rights owner to list their products in your listings and you have to purchase the product from the authorized supplier who are directly linked with the brand. Without having written consent from the rights owner we can’t use their trademark/copyright in any forms.

Below are some questions to help you to understand for preparing a new appeal to get your selling privileges back, a plan of action must be in the following format:

  1. Root cause(s):

Why did you receive the Copyright /Trademark Infringement on these Particular ASINs? How did you list the ASIN?

Was it listed by you or anyone else?

Did you seek permissions from Rights Owner before mapping (If mapped)?

If you have permissions, provide the same. If you don’t have the permission, please explain that why you have used it?

Did you have gone through Amazon Intellectual Property policies before listing your items?

If not, why you didn’t gone through the policy pages?

What are the points you are checking out once you listing any item?

  1. Corrective measures:

When you have received the complaints, what are the actions you have taken?

Did you deleted them? If not, why you haven’t deleted them?

Did you contact the Right’s owner and worked with them to clear this issues?

Did you check your existing listings to see for any infringement which may have gone unnoticed?

  1. Preventive steps:

Did you implement what all mentioned as corrective actions?

How will you make sure that any Infringement related issues will not happen in your account going forward?

How will you make sure the listings are abiding Amazon Listing /Intellectual Property Policy?

From where will you purchase the products going forward?

When you list any product to your Inventory, from where will you get the images for your listings?

From third party websites/Clicking by yourself?

How will you make sure that the listings are 100% accurate to Amazon policies?

What are the changes you can bring in to control or to avoid similar violations going forward?

If you are not authorized to sell a brand, how will you avoid listing a branded item?

So, we request you to prepare more specific plan of action instead of giving generic reply in your new appeal.

Once you are ready with your new appeal, you may submit the same from the appeal button on the account health dashboard.
