Do we need to be VAT registered in the EU for DDP from the UK

Hi,

Can someone please clear this up for us?
If we sell an item on Amazon.co.uk or amazon.de and post the item from the UK to Germany DDP, do we need to be VAT registered in Germany?

Does the answer differ if the value of the goods us under/over 22 Euros?

Does this apply for all EU countries when posting from the UK?

You don’t have to be VAT registered in Germany to send DDP but if you are not registered, you won’t be able to claim back the import VAT. If you do register, then you will have to charge sales VAT as well but you will be able to claim the import VAT back*.

*If you do subsequently register for VAT in Germany and your packages do not clear there, then you will not be able to claim the import VAT back in Germany. For example, if your packages clear in France first then you would have to register for VAT in France to claim the import VAT back.

If the value of the order is under €22 then no import taxes are due. There are two countries where the limit is lower (€10 IIRC) but I don’t know which two off hand.
