Basically, if you don’t have an office or warehouse that is actually staffed and managed, in the UK, you are a NETP.
As such, you do not have the benefit of the threshold (85k, not £80k), and will have to register for VAT, the moment your goods hit the UK shore.

If your really not sure and want to confirm it, ring HMRC. They will tell you straight.

Ok, in that case, it sounds like they are trying to work the system.
This the law that they are trying to get you around, which is really not a good idea.
Of all the various agencies etc, HMRC is possibly the most powerful and the one that you don’t want to cross.

Take a look at the below link, it gives a fairly detailed explanation of the way things work.

So, the ‘person’ you are dealing with is misleading you and not totally honest.

And if they have forged documents that have then been provided to Amazon, then it may well be game over, as that is a Red Liine you cannot cross with Amazon, forged documentation will be almost impossible to recover from.

9.2 UK establishment: definition

A UK establishment exists if either the:

  • place where essential management decisions are made and the business’s central administration is carried out is in the UK
  • business has a permanent physical presence with the human and technical resources to make or receive taxable supplies in the UK

We would normally consider a company which is incorporated in the UK to have an establishment in the UK as long as it’s able to receive business supplies at its registered office.

in the light of last paragraph, i think i am not NEPT, m i right or not?

Yes, your a NETP. That is why if you store stock in the UK, you must be registered for VAT.
It’s exactly what was trying to be avoided.

No, this is enough to run a business.
