Suspended for Intellectual Property Rights

Hi, I’m a new seller and a few days ago I recieved notices for a few ASIN’s saying that they had violated the Amazon policies and guidelines. I have a few questions - I have submitted a plan of action but this was my third attempt as they kept asking for more detail so I did. I have submitted a day ago and still waiting for a response.

Will my account be reinstated because it’s the first time?

However, my account status does show as deactivated so I am quite scared… please advise

word of advice when lodging a appeal.
Put you ‘HAVE’ carried out the changes etc and do NOT put ‘WILL’
Amazon want to see that you have already carried out what is needed not what you are going to do.
That said, being a new account! you need to be scared as Amazon are all too quick to close new accounts.

Also, do you know how they ask for proof of non-infringement, I dont have any so how would i say this, do i just say i buy of Alibaba or what do I say please help. They just sent me this;

So you were selling counterfeits of Apple design and you got caught red handed.

It is going to be hard to come back from it as Amazon is clamping really hard on this stuff (and rightfully so IMO)

First of all you need to understand what you did wrong (it is not that you got caught, it is that you were selling a direct counterfeit of someone else design and this is illegal)

Then you need to work your plan of action around it…

No I did not list them as counterfeits, they are called i12 TWS but there is no generic brand so the first listing that came up I thought it would be the same so I listed it so that’s why. I did not list the real airpods as these that is very illegal. I just dont know what to say now?

Dear Amazon Seller Performance Team,

Root Cause

  • The reason why I believe my seller account has been suspended is because I listed products that I was not allowed to, these were products that were owned by brands and we infringed Amazons policies and guidelines. The listings that were affected and they’re ASIN’s are B083JG36V1,B082CPDJXF
  • I believe that I did unknowingly commit a terrible mistake that I deeply regret and as a new seller i did not read Amazons policies and guidelines before listing my products.
  • I take full responsibility for these actions and would like to talk about my plan of action to STOP this from happening again.

Actions I have taken to resolve the infringement issues

  • Firstly, I have contacted all the owners of the brand and I have formally apologised and told them about the situation about how I bought inventory and unknowingly listed it as their brand.
  • I have also now taken time to read through Amazons polices on infringement and other sectors like copyright and patents, I will regularly be reading through the policies to check for updates and changes in the law.
  • I have and will continue to check my inventory to see if I have products and listings that I am violating, i will make sure that i am listing the right product because i know it will lead me to a suspension like this again.
  • I will make sure that I buy inventory from reliable sources because at the moment I do not have invoices.
  • I have also deactivated the ASIN’s - B083JG36V1,B082CPDJXF
  • Finally, I will also make sure that in my Amazon Seller Central I keep my Amazon policies and guideline violations to under zero so that I won’t get suspended again.

Greater detail on why you believe an error occurred

  • I believe that it wasn’t an error but it was an honest mistake made by me. As I am a new seller I wasn’t concentrating on the Amazon policies and guidelines but just started to list products without checking for infringement or violations.
  • As I did not have any bad intentions of selling the wrong products under the wrong brand names I can see why brand owners would report me and I have written to them asking to retract their complaint and I also explained the situation.
    Also I will check my inventory for any defects and if there are any I will make sure that I choose the correct listing for the product and amend any details to make it correct.
  • in the future I will be making sure that I seek permission from Amazon and BRAND OWNERS first so that I will not be reported again.

I believe that this plan of action does address the problem that was noted by the Amazon Seller Performance Team and my solutions to them. Also, just to let you know I do not have any invoices or Order ID.
