Brands selling other branded products under their own brand. What are the rules?

Many sellers are selling branded products from another company under their own brand. This makes the listing a misrepresentation given that a customer believes they are buying from one brand, but the product is actually from another. Is this allowed?

Below, I have listed the Asin for the probiotic chew supplement from the brand Oimmal, and beneath it there are 8 other Asins for brands selling the same product or variations of this Oimmal product.

This same thing happens in many categories. Given that to list my products I had to show extensive evidence of my branding being on my products, along with a specialist call with brand registry where I had to show 50 branded units of my product, I'm curious why this is permitted and what the specific rules about this are?

I've also come across this. Although I cant answer your question directly, I believe its a way for sellers to restrict anyone else from listing on their ASIN.

Having being stung by this, I would advise to check the 'Brand' title prior to purchasing stock. In my opinion it's a 'clever' way of being exclusive but certainly something Amazon need to do more to prevent.

it isn’t allowed, but Amazon appear to have zero means of policing it.

As above what tends to be happening is sellers get a brand registered that matches their store front.

They buy GS1 barcodes then list these branded goods as their own brand. This can occur on smaller brands all the way up to Cadbury. Sometimes the sellers will bundle a cheap additional product to claim it as their own brand.

If the brand in question every asked Amazon to remove these listings, they would likely be removed, but when Cadbury aren’t even bothered, you can see that this is unlikely.
