Individual vs Private Business Seller

I'm from Portugal and registered as an individual seller, since I have low sales (less than 40/month). Now Amazon doesn't want me to be a individual seller because I'm selling new items and according to amazon's policies that is selling for profit and I should be registered a business.

What documents are necessary to verify my private seller account? Should I want to continue selling my new items. I don't have a business registration because it simply is not necessary at Portugal

This is Ka from the Forums Community Management team. I hope you are doing well.

I understand that you have concerned about the requirements to sell in Spain and/or Portugal.

Since we don't have a Selling on Amazon in Portugal directly, you need to sign up in one of the European countries available that suits best for you.

This is going to be a long explanation, but please bear with me to clarify the differences between selling plans and type of business.

First, when we talk about our Selling Plans (Individual or Professional), it is just the difference of available features and monthly charges between them, nothing else.

If you intend to sell on Amazon for a profit, it doesn't matter which selling plan you select, most importantly is the type of business you select or setup during the sign-up process.

To simplify this answer, I will mention only 3 of the 6 options for business type during the account setup, and this is the part where new sellers need to set up their account correctly:

  • None, I am an individual: An Individual is selling in the context of a private activity. An individual is not selling any product on behalf of a company/charity and is not acting in the context of a commercial or professional activity.
  • Sole Proprietor: A Sole Proprietorship is a business entity owned and run by one individual and in which there is no distinction between the owner and the business. This individual is selling for commercial and professional purposes and cannot register as an individual.
  • Privately-owned business: A Privately-owned business is a business that is controlled and operated by more than one person. The business seller is registered in the context of a commercial or professional activity.

To give you an example, you can have a sole proprietorship business or even a privately-owned business, and still choose the Individual plan. This type of setup is when you are not going to intend to sell more than 40 items per month, do not need any of the Professional plan features and don't want to have a monthly charge. But, you need to provide documentation to sustained your commercial activity.

However, if you select an Individual plan and state that you are individual, this setup is not recommended if you are planning to sell items to make a profit. This setup is only to sell used products you don't need and once in a while.

Now, regardless of the selling plan selected, if you are intended to make a profit and have a repetitive practice of a commercial activity, you will be considered a merchant due to its habitually. Therefore, you will need to provide the all the documentation required that our seller support team has mentioned in the case ending in 0932 or any equivalent information in your country of residence.
