Amazon has rejected advertising for some of our bestselling products on HFSS grounds.
However, under HFSS law, our listings are exempt from advertising restrictions because we’re a small specialist manufacturer and retailer with fewer than 50 employees. Essentially, these regulations are aimed at large retailers like Tesco's and not local corner shops.
So it would be understandable for HFSS laws to be applied to our products if Amazon is the retailer, however we have it in writing from Amazon that they view us as the retailer.
They said - "Even though the order is fulfilled by Amazon, the Amazon offer page will show 'sold by Your SERIOUS PIG' tag, which presents you as the retailer."
This admission from Amazon proves that the HFSS laws are being misapplied in our case, but despite this I am unable to talk to anyone willing to have a conversation about it. I just keep getting the same unhelpful copy paste answers.
This week I am sending multiple pallets of stock that were destined for FBA fulfilment centres to TikTok fulfilment centres instead. The rates are better there and they apply HFSS law properly. They have totally misunderstood and mismanaged this since day 1. They even publically admitted it was a shambles and vowed to improve, but never have. We havent advertised an item for 2 years on here.

If you are a private seller FBA or FBM, then technically, you should be able to list all of your items as "out of scope". Problem is though, all current listings are locked.
