Chinese fake seller hijacking my listing

Hi Guys, this is my first time posting here.

Massively frustrated that a Chinese seller has hijacked our listing, is clearly not selling our brand and is just selling a generic product. I have contacted Amazon and they have said they won’t do anything about it.

We are the original listing creators, the brand creator, have the most sales and the lowest price and for some reason these Chinese sellers that are not FBA are sometimes winning the buy box. I checked our Account health and we have 0 issues. The buy box algorithm does not seem to make any sense, is it because they have a lot of fake Seller feedback that they are winning?

We are lost what to do, how do people tackle Chinese sellers that are obviously selling lower quality fake products? Why is Amazon letting this happen it is going to hurt them in the long run as the quality of the products will suffer.

Have you placed any test orders to verify if the goods are the same?

In case the items are found to be counterfeit, you could report the violation through the Brand registry, by choosing “Trademark infringement” and then “A product is counterfeit”. Also, include the following message:

“It has come to our attention that seller “xxxx” is selling counterfeit items using our Trademark protected brand name.

Our trademark can be seen here: LINK TO TRADEMARK

Please remove the seller “xxxx”.”

Otherwise, the other options include submitting a report using the “Report a violation” feature available within the “Contact us” menu or taking a legal action.

It is frustrating, I have it with a couple of my products, they undercut, get bad reviews as it is counterfeit, quit, leave for a bit and come back with a new account to do the same thing…

I have brand registry and am trademarked. A Chinese seller jumped on the listing and they won’t get removed by Amazon. The seller is also not VAT registered, they are not using my GS1 barcode yet Amazon still allows them to do what they want regardless of the fact they don’t want to get involved in property rights infringements.

Firstly the Chinese seller does not have to be VAT registered if the stock is not held in the UK. The good news is that there is now Amazon Transparency which has recently been launched. You place a sticker on your product and nobody else can sell that product unless they show the sticker you paid for. €0.04 per unit. https://brandservices.amazon.com/transparency

Enroll your product for brand registry and you will have 0 issues with other sellers hi-jacking listings.

You order the stickers and download and fix them yourself or send to your manufacturer. In order for your manufacturer to print them they must have variable product label printing capabilities. If your manufacturers are in China you can upload the labels to a company called Fineline Technology in China and they will print and send directly on your behalf to your supplier. They do charge for this service and I paid $16 for 800 labels plus $20 shipping. Amazon do not offer a service to attach these labels for you.
