How can somebody have a brand without a trademark?

Sorry if this is a duplicate post. I can’t find the previous one.
I’m just trying to get my head around listings products on Amazon (it’s not the most intuitive system), and I noticed that someone in selling our products (plants) on Amazon. They are taking orders through Amazon, and then purchasing our products through eBay and shipping to the Amazon customers. That’s not so much of problem, although he’s taking the mickey with his prices - another pandemic ripoff merchant - but he has our old trading name in the product title: i.e. Raspberry All Gold Plug Plant by ediplants. I thought this was the ‘brand’ which required you to enrol in brand registry with Amazon which required you to have a trademark? I would like to put our new trading name on the title, but can only muster a ‘NA’ at the moment. How has he done it?

It also adds the issue that if I want to sell the same product, I would have to use his listings (ASINs) with our old name on. Would getting our new name into the brand registry solve this issue. Can I list the same product, but under a different brand and EAN? Thanks in advance.

This is nothing new, it’s called dropshipping, and it’s not a person, it’s a computer programme scouring ebay, Amazon and other places for arbitage.
You could lose sleep over this, but I advise you not to, because the computer programme is not going to recognise the regulatory hoops you may go through, it only sees price and profit, and nothing you do will stop this from happening.
