Arbitrage if no listing

I found a product in a store but has no listing on Amazon. Can I create a new listing using the EAN on the product box? Is it legal?

Retail arbitrage is not a good idea for a new seller
Firstly, you have no valid supply chain to prove authenticity
Secondly, you may not have permission to create a listing under the brand name

Legal? Yes
But your real question should be is it ok to sell on Amazon.
Amazon have policies preventing people selling arbitrage items as New
Also, if it is branded goods there are a whole raft of other policies which you may fall foul of such as proving authenticity, permission to sell, etc as TLS has said.
Assuming you are not falling foul of Amazon policies then yes you can add the item to the Amazon catalog and create a listing using the EAN code - but you also need to check policies on images etc (images have to be certain sizes, on a white background, no models, etc)
